TIPTON COUNTY

County of Tipton and State of Tennessee being of sound mind and desposing memory do make and ordain as my last will and testament hereby revoking and making void any and all other wills by me at any time made.

FIRST: I have heretofore advanced to my children as follows, to wit, I have given to each of my sons Samuel D. Elam, Thomas E. Elam, Edward T.Elam, and William I. Elam, and to my deceased daugther and her heirs, Lucy E. Mays, the sum of seventeen hundred dollars in money each, and I have also given to each of my sons, John C. Elam, Andrew H. Elam, and Daniel B. Elam and my daughter Sarah A. Slate wife of Robert Slate, a tract of land valued by me at fifteen hundred dollars and the sum of two hundred dollars in money each; and at this date I consider and so will that all my said children have received equal portions of my estate, each one have received the sum of seventeen hundred dollars in money or its equialent in land as above stated, and I hereby will devise and bequeath the remainder of my estate as follows, to wit, I direct that all of my just debts be paid as soon after my death as possible, out of any moneys that I may die possessed of or may first come into the hands of my executors here after named.

SECOND: I have sold to my son John C. Elam a tract of land lying in Tipton County, Tennessee, and I now hold his notes for the same for the sum of four hundred dollars each, the 1st of said notes due January 1st 1873, the second of said notes due January 1st 1874 and the last of said notes due January 1st 1875. Should I fail to collect said notes in my lifetime; my executor is directed to collect the same, or any balance that may be due on said notes at my death, and to pay the amount collected by him equally amoungst all of my said children, and the represenatives of such of them as my be dead, my son John C. Elam, and my grand daughter Mary L. Mays taking equal shares with my other children.

THIRD: I will and devise the tract of land on which I now reside in Tipton County Tennessee containing about ninty acres more or less to my beloved wife Sarah I. Elam during her natural life, and at her death to go to my son Daniel B. Elam and his heirs; but I direct and I will and devise that
in consideration for said land, that my son Daniel B. Elam, pay to my other children, and the representatives of such of them as may be dead the sum of twenty seven hundred dollars one third of said amount to be paid by him 12 months from the date of my death or from the date of the death of
my said wife should she survive me. One third of said amount to be paid by him in 24 months from the date of my death or the death of the survivor, and the remaining third to be paid by him 36 months from the date of my death or the death of the survivor, each of said payments when made to
be equally divided among all of my said children and the representatives of such of them as may be dead including the said Daniel share and share alike and in case my son Daniel B. Elam shall pay to me in my life time said sum of twenty seven hundred dollars for said land in whole or in part, I will give him my receipt for the same, as for such sum as he may pay me, Which sum so paid shall be entered, as a credit, on said sum of twenty seven hundred dollars.

FOURTH: The remainder of my personal estate after the payment of my debts, and the expenses of administration, I will and bequeath to my beloved wife Sarah I. Elam for and during her natural life and at her death, to be equally divided among all of my said children, and the representatives of such
of them as may be dead share and share alike.

FIFTHLY: I do hereby nominate and appoint my sons Edward T. Elam and Andrew H. Elam my executors and the court is requested not to require of them bond for the execution of my will and their giving bond as my executors is hereby expressly waived.

In witness where of I do to this my will set my hand this December the 8th, 1871.

Another entry in courts records: "Last Will Edward Elam: E.T.Elam, A.H. Elam produced in open court a writing perporting to be the last will and testament of Edward Elam deceased. It appearing from the testimony of G.W. Smith and of the subscribing witness thereto that said writing dated 8th
Dec. 1871 as produced here in court is as it perports to be the last will and testament of said Edward Elam deceased. It further appears that the said E.T. Elam and A.H. Elam are in said will appointed executors thereof - and they having been sworn to perform said will and they having been
excused by said will from giving any bond - It is ordered that they be clothed with all the powers and charged with all the duties pertaining to the execution of said will.'
