| This Indenture made and entered into this 23rd day of June 1819 between
Absolom AILSTOCK of the County of Louisa of the one part & William JACKSON
& Edmund PENDLETON of the said County of the other part Witnesseth that
the said Absolom AILSTOCK in order to secure the payment of eighty eight
dollars fifty & Half cents which he is justly indebted to Henry PENDLETON
by note of this days date and further to secure the said Henry PENDLETON
for some money now due in notes of hand or pryor date of whatever he may
hereafter be indebted to the said PENDLETON on store or other accounts and
moreover for and in consideration of one dollar in hand paid by the said
William JACKSON & Edmund PENDLETON the rect. whereof is hereby acknowledged
& confesed hath granted bargained and sold and by these presents doth
grant bargain and sell unto the said William JACKSON and Edmund PENDLETON
one moiety of a tract of undis(can't make out rest of word) land purchased
by the said Absolom & John AILSTOCK of John P. THOMPSON lying and being
in the County of Lousia and adjoining the lands of Meriwether SMITH,
William TALLY and others, containing by estimation one hundred
and twelve acres be the same more or less also two feather beds with
all the balance of my household and kitchen furniture, also three head
of cattle & nine head of hogs. To have and to hold the afore mentioned
tract of land together with the aforesaid two heads ballance of household
& kitchen furniture cattle hogs& with all and singular the appurtenances
thereunto belonging to the said William JACKSON & Edmund PENDLETON their
heirs executors ? & the sd Absolom Ailstock for himself heirs executors
? will forever warrent & defend clear of the claim or claims of himself
the said Absolom AILSTOCK and of all and every person or person or persons
whatever: Upon trust nevertheless that the said William JACKSON & Edmund
PENDLETON or either of them shall as soon as conveniently they or
either of them can after the 1st day of Decr next having
advertised the same three weeks previously at Louisa Court House proceed
to sell the said land and aforementioned property on the premises to
the highest bidder for ready money & the monies arising therefrom
after defraying all charges attending this conveyance & the said sale
shall pay to the said Henry PENDLETON the sum of eighty eight dollars &
fifty & half cents with the Interest thereon an also pay the said PENDLETON
any money that may be owing by note of pryor date or on open account &
the ballance if any to be paid to the said Absolom AILSTOCK provided always
nevertheless that if the said Absolom AILSTOCK shall well and truly pay unto
the said PENDLETON the sum of eighty eight dollars fifty & half
cents with the intr thereon on or before the 1st day of Decr next an
also Jany all other moneys he may be indebted sd PENDLETON by bond or otherwise
and also pay all cost attending this conveyance then this deed of conveyance
shall be void & of no effect whatsoever otherwise to remain in full
force.
