Burgess CRANFORD Will 1885 Transcibed |
| Upon the evidence here addressed it is adjudged that the paper
writing exhibited and every part and clause thereof in the Last Will and
Testament of Burgess CRANFORD which said Last Will and Testament is the words
and figures following to wit:
I, Burgess CRANFORD, being week in body but of sound mind and memory and knowing the uncertainty of human life, do make and declare in word and figure following. To wit. First - It is my desire that all my just debts wherever and to whomsoever owing be paid by my executor herein after named out of any money that may come to his hands belonging to my estate. Second- I give to Mary Jane HARRISON, wife of Albert J. HARRISON all my property, both real and personal, that I may own at my death, to be his for the time of her natural life and at her death to go to her children, provided that she and her husband above named shall live with me and take care of me and my wife Lavina as long as we, or the survivor may live, furnish us and each of us a comfortable home with suitable food and clothing and kind attention and nursing in sickness and health and shall give to us and each of us respectable christian burial when dead. But if the said Mary Jane Harrison and her husband shall fail to comply with the conditions above stated, then she shall not take any of my property under this will. Third- It is further my will that if Mary Jane HARRISON should died before her husband Albert HARRISON then and int hat event he shall use and enjoy the property hereby given to Mary Jane HARRISON during his life time, provided he shall carry out and discharge the duties and obligations imposed upon his wife in the Second clause of this will. And at his death all the property he has had the use of as belonging to his wife shall go to the children of Mary Jane HARRISON. Forth. I hereby appoint Albert J. HARRISON as the Executor of this my last will and testament hereby revoking any and all former wills that I have made. HARRISON being duly sworn, doth say: That Burgess CRANFORD, late of said County is dead, having just made and published his last will and Testament; and that J. A. HARRISON is the executor named therein. Further that the property of the said Burgess CRANFORD counting of Real and Personal is worth about $1000.)), so far as can be ascertained at the date of this application, and that Mary Jane HARRISON is the party entitled under said will to be the said property. J.A. HARRISON Sworn to and subscribed before me this 7th day of november 1885} J.M. HORAH C.S.C.
I, J. A. HARRISON do solomenly swear that I believe this writing to be and contain the last Will and Testament of Burgess CRANFORD; deceased, and that I will will and truly execute the same, by first paying his debts, and then his legacies, as far as the said Estate shall extend, or the Law will charge; and that I will well and faithfully execute the office of Executor, agreeably to the trust and confidence ? in me, and according to Law; so help me God. J. A. HARRISON Sworn and subscribed before me this the 7th day of November 1885} J.M. HORAH, C.S.C. State of North Carolina, Rowan County. By the Clerk of the Superior Court for the County of Rowan. To All to whom these presents shall come, Greeting : Whereas it hath been made to appear to me, J.M. HORAH, C.S.C. for Rowan County, that Burgess CRANFORD, late of said County is dead, and has made a last Will and Testament in writing, which was exhibited to me as Clerk of aforesaid and duly proved, wherein the said Testator hath appointed J.A. HARRISON Executor thereof; And the said J.A. HARRISON hath duly qualified as Executor as aforesaid. Then and therefore to authorize and empower the said J.A. HARRISON as Executor as a aforesaid, to take into his possession all and singular the goods and chattels, rights and credits of the said Testator, wheresoever in this State to be found; and a true and perfect inventory thereof return on oath to the Clerk of the Court for Rowan County, within the time prescribed by law; and all the just debts of the said Testator to pay, so far as the said estate, shall extend or amount to; and in all other things to execute the said Will and Testament, agreeably to law and his office and duly as Executor.
