M.F. CRANFORD To J.R. HAMILTON Deed 1901 |

THIS Deed, Made this Eleventh day of November, 1901, between W.S. CRANFORD and M.F. CRANFORD of the first part, and J.R. HAMILTON of the County of Montgomery and State of North Carolina, of the second part, WITNESSETH: That the said parties of the first part, for and in consideration of the sum of fifty Dollars, in hand paid by the said party of the second part, the receipt whereof is hereby acknowledged have bargained and sold, conveyed and confirmed, and by these presents do bargain, sell, convey and confirm, unto the said part of the second part, heirs and assigns one-third agricultural interest, minerals excepted in a piece or parcel of land in the Uwharrie township, County of Montgomery, and State of North Carolina, and known and designated as follows, viz: Two tracts: 1st tract adjoining Alex HURLEY, Joseph HURLEY and others & part of the Joseph HURLEY tract, Beginning at a stake in Spencer Creek and runs North 150 poles to a pine, thence W. 80 poles to a stake in a certain hollow or branch, then down the branch to the creek (Spencer's Creek), thence up various courses of the creek to the beginning corner 140 poles containing 100 acres more or less, as described in deed of Joseph HURLEY to Adaline HURLEY dated 4th August 1860 recorded in teh office of Register of Deeds of said county, April 11th 1870, Book 21, pages 607, 608, 609. Second tract, adjoining same. Beginning at a stake, Adaline CRANFORD's northwest corner and runs north to the road leading from Zoar Church Mrs. Mary CRANFORD's and runs with said road to the eastern tunminus of Elias HURLEY hundred acre tract, then to the Adaline CRANFORD's north eastern corner, then west with her line to the beginning containing five acres more or less as described in deed of Elias HURLEY & wife M.A. HURLEY dated 24th day of November 1873 and recorded in office of Register of Deeds of said county Book 23, page 411, Janry 10th, 1875. This deed intended to convey the agricultural interest in one third of the lands above described, the mineral interest being retained in the same. TO HAVE AND TO HOLD THE SAME, Together with all the hereditaments and appurtenances thereunto in anywise appertaining. And the said W.S. CRANFORD & M.F. CRANFORD, parties of the first part, do covenant with the said party of the second part, his heirs and assigns. That they are lawfully seized one third of said premises in fee, and have right to convey the same in fee simple; that the same are free from all encumbrances, and that they will warrant and defend the title to the same against all lawful claims. HUNSUCKER, a Justice of the Peace, do hereby certify that M.S. CRANFORD and M.F. CRANFORD, his wife, personally appeared before me this day and acknowledged the due execution of the within deed of Conveyance; and the said M.F. CRANFORD, being by me privately examined, separate and apart from her said husband, touching her voluntary execution of the same, doth state that she signed the same freely and voluntarily, without fear or compulsion of her said husband, or any other person, and that she doth still voluntarily assent thereto.
