John AILSTOCK 1829 Deed Transcribed

This Indenture made this 20th day of June 1829 between John AILSTOCK of Lousia County of the one part and Francis A. HOUCHINS and William N. WALDROPE of said County of the other part: Whereas the said John AILSTOCK is justly indebted to Edmund BULLOCK in the sum of sixty four dollars and nine cents good and lawful money of Virginia to be paid on or before the 25th of December next by penal bond bearing equal date with these presents, which debt with the interest should any acrue, the said John AILSTOCK is desirous to secure: Now this Indenture Witnesseth; that for and in consideration of the premises and for the further consideration of One dollar to the said John AILSTOCK in hand paid by the said Francis A. HOUCHENS and William A. WALDROPE, the reciept of which is hereby acknowledged the said doth grant bargin and sell to the said HOUCHINS and WALDROPE their heirs and assigns forever a yoke of Oxen a Cow and Calf two hogs and his growing Tobacco Crop, warrenting a good right and Title to the said HOUCHINS and WALDROP against the claims of all persons whatever: In Trust nevertheless that the said HOUCHINS and WALDROPE shall permit the said John AILSTOCK to remain in possession of the above named property to his own use, untill default be made in the payment of the said sum of Sixty four dollars and nine cents either in whole or in part.  Thant then they or either of them, so soon as they may think proper, or the said Edmund BULLOCK require, make sale of the above named property or so much thereof as may be necessary, to the highest bidder for cash ready (after having advanced the time and place of such sale at last publick places in said County at least three weeks previous to such sales and out of the money rising therefrom after paying all charges attending the execution of this deed, and a reasonable commission to themselves shall pay the said Edmund BULLOCK his heirs or assigns the sum due him and the balance of any shall be paid to the said John AILSTOCK his heirs or assigns.   But in case no default  be made in the payment of said debt then the Indenture to be void.  In Witness Whereof the parties have set their hand and seals this day and year first above written.
