| This Indenture made and entered into this 23rd day of June One thousand
eight hundred and nineteen between John AILSTOCK of the County of Lousia
of the one part and William JACKSON jr. and Edmund PENDLETON of of said County
of the other part Witnesseth that the said John AILSTOCK in order to secure
the payment of One hundred & thirty four dollars and eighty four cents
which he is indebted to Henry PENDLETON by note bearing date this day and
further to secure said PENDLETON some money now due on notes of hand of prior
date and also whatever he may hereafter become indebted to said PENDLETON
on store or other accounts and moreover for an in consideration of the sum
of the sum of One Dollar to him in hand paid by the said William Jackson
& Edmund PENDLETON the rect: whereof is hereby acknowledged
Page 362 before the enscaling and delivery of these hath granted bargained and sold and by these presents doth Grant bargain and sell unto the said William Jackson jr. & Edmund PENDLETON one morety of a tract of undevided Land purchased by the said John & Absolam AILSTOCK of John P. THOMPSON lying and being in the County of Lousia and adjoining the Lands of Meriwether SMITH William KELLEY & others and containing by estimation one hundred & twelve acres be the same more or less also one sorrel horse blaze face four head of cattle seven head of Hogs one feather bed & furniture and all my other house hold and Kitchen Furniture To have and to hold the aforesaid Tract of Land together with the aforesaid Horses 4 cattle seven head of hogs one feather bed & furniture & house hold & kitchen furniture with all and singular the appurtances thereto belonging to the said William JACKSON & Edmund PENDLETON and their heirs Executors, ?C and the said John AILSTOCK for himself his Heirs ?.C. will forever warrent and defend clear of the claim or claims of him the said John AILSTOCK and of all and every person or persons Whatsoever upon trust nevertheless that the said William JACKSON and Edmund PENDLETON or either of them shall as soon as conveniently by they or either of them can after the first day of December next, having advertised the same thence weeks preciously at Louisa Courthouse proceed to sell the said land and aforementioned property on the premises to the highest bidder for ready money and out of the monies arising therefrom after first defraying all costs and Charges attending this Convey and the said sale pay the said Henry PENDLETON the sum of One Hundred and thirty four dollars and eighty four cents and all other monies he the said John AILSTOCK may then be indebted to the said Henry PENDLETON and the ballance if any to be paid to the said John AILSTOCK provided always nevertheless that if the said John AILSTOCK shall well and truly pay to the said Henry PENDLETON the sum of one Hundred & thirty four dollars and eighty four cents with Interest from this day on or before the first day of Decr next ??uing and all other money he may be indebted to said Henry PENDLETON by bond or otherwise and also pay all costs attending this conveyance, then this Deed of Conveyance shall be void and of no effect whatsoever otherwise remain in full force. An Indenture of Bargain and sale between John AILSTOCK of the one part and William JACKSON jr. & Edmund PENDLETON Trustees for Henry PENDLETON of the other part was this day presented in Open Court and acknowledged by said AILSTOCK to be his act and deed and is thereupon ordered to be record.
