Mary CARDEN Will Transcribed

I Mary Carden (widow and devisee of John Carden) of the city of Pittston, Luzerne County, Pennsylvania, being of sound mind and memory and understanding do make and publish this my last will and testament. And first I direct- that- my body be decently interred in the Roman Catholic cemetery in Pittston according to the rites and ceremonies of the Roman Catholic Church and that my funeral be conducted in a manner corresponding with my estate and situation in life.  As to such estate as it hath pleased God to entrust me with I dispose of the same as follows, viz:  Item: I give and bequeath to my daughter Catherine the sum of Five Dollars ($5.00)  Item: I give and bequeath to my daughter Bridget- the sum of Five Dollars ($5.00)  Item: I give and bequeath to my daughter Maria, the sum of Five Dollars ($5.00)  Item: I give and bequeath to my son, John, the sum of Five Dollars ($5.00)   Item: I give and bequeath to my son, William, the sum of One Hundred Dollars ($100.)         Item: I give and bequeath to my daughter, Agnes, the sum of One Hundred Dollars. ($100.) Item: I give and bequeath to my son James, my Lot No 16 on John Street in the city of Pittston, as per map in the office of  the Pennsylvania Coal Company.  To have and to hold the same to him and his heirs and assigns forever.   Item: I give and devise to my son Patrick, my Lot formed on the Southwesternly halves of Lots Nos. 12 and 14 on John Street in the City of Pittston as per map in the office of the Pennsylvania Coal Company.  Said devised lot being fifty seven and one half (57 1.2) feet on Emmett Street and extending ninety (90) feet deep at right angles to Emmett Street and adjoining a private alley now claimed as the property of the late John Langan, deceased, to have and to hold the same to him and his heirs absolutely forever.  Item: I give and devise to my son James, and my daughter Ellen, share and share alike, my lot formed of the northeasternly halves of Lots Nos. 12 and 14 on John Street in the City of Pittston as per map in the office of the Pennsylvania Coal Company.  Said devised Lot being fifty seven and one half (57 1/2) feet on Emmett Street and extending ninety (90) feet deep at right angles to Emmett Street and adjoining John Street - aforesaid, together with the dwelling house and other improvements Thereon, To have and to hold the same to them and their heirs forever.   Provided however that my son, Frank shall have the free privilege of the said dwelling house as a home for his own use only, as long as he lives and behaves well and peacefully.   Item: I give and bequeath to my son, Frank the sum of One Hundred dollars ($100.) payable at the expiration of three years after the date of my death.   Item: I give and bequeath to my executors out of any moneys left by me after paying the forgoing bequests and expenses of administration the sum of Five hundred dollars ($500.) age a fund to be held by them and used for any necessary repairs to the dwelling houses and other improvements on my property hereby devised, until such fund is exhausted.   Item:  I do hereby constitute and appoint my son James and daughter Ellen, Executors of this my last will and testament.       In witness whereof I, Mary Carden, the testatrix, have to this my last will and testament set my hand and seal thi Sixth day of October A.D. 1905.  Signed, sealed, published and delivered by the above named Mary Carden, as and for her last will and testament, in the presence of us, who have hereunto subscribed our names as witnesses thereto, in the presence of the said testatrix and of each other.   Edward Barrett  C. F. Bohan the subscribing witnesses to the above and foregoing last will and testament of Mary Carden late of the City of Pittston Luzerne and State of Pennsylvania, deceased, who being duly sworn according to law do say that they were present and saw and heard Mary Carden the testatrix sign, by her mark, seal publish pronounce and declare the foregoing instrument of writing as and for her last will and testament and that at the time of so doing she was of sound mind memory and understanding to the best of their knowledge and belief, and that they did sign their names as subscribing witnesses in the presence of each other  and in the presence and at the request of the said testator. Sworn and subscribed before me The day and year above written  Frank A Battle Register  Edward Barrett  C.
