Temple CRANFORD Will 1871 Transcribed

I Temple CRANFORD of the County of Randolph and State of North Carolina Being of sound memory, considering the uncertainty of my earthly exsistance do make and publish this my last will and testament in manner and form hereby revoking all former wills by me at any time heretofore made.

First.   That my executor (herein after named) shall provide for my body a decent burial suitable to the wishes of my relations and friends and pay all funeral expenses together with my just debts  howsoever and to whomsoever owing out of the money the may first come into his or her hands as a part or parcle of my estate.

Item 2nd.  I give and devise to my beloved wife Quinny Ann CRANFORD One Hundred  and Twenty five  acres of land.  The tract on which I now reside also one tract known as the VARNER or mountain tract  containing Seventy four acres. Together with all and singular all my household furniture,  my horses, waggons, gearing, Stock of every kind, including my mansion house and every thing pretaining thereto. Together with all my provisions on hand at my death. All my profits and rents accring (sic) from the above willed property to be hers during the term of her natural life.

Item 3rd.   I give and bequeath to my daughter Christinannie T. (this could be a "P") wife of  Jason L. ANDREWS - One Burea (sic) one bed and furniture  one side saddle or its equivalant, one set of chairs, one trunk, one Cow and calf, and One Hundred and forty dollars all of which she has heretofore had -

Item 4th.  I  give and bequeath to my daughter Martilia M. (Single Woman) one Bureu (sic) one bed and furniture and one set of chairs al of which she now claims and is understood in the family to be hers - also Forty dollars in money or its equivilant which she  has heretofore had, And one hundred and ten dollars.

Item 5th.   I give and bequeath to my daughter Martha S. one Bureau which she now claims and the ballance (sic) to make her equal with Christiannie ANDREWS and Martilia M. CRANFORD.  My will and desire is that my executor hereafter named pay over to Martha her equitable share.  Share & share a like -

Item 6   I give and devise to  my Two youngest sons Travis McLaurin and Hill C. one rifle gun each, and then to share and share alike with my children above named -

Item 7th   My will and desire is that after all my children shall be made equal and share a like that the residue of money and notes I give and bequeath to my beloved wife Quinny ann CRANFORD during her natural life and after her death all of the property and effects every kind to be sold and equally divided among all my children.My will and desire is that my To youngest sons Travis MCLAURIN and Hill C. at the death of my wife take the aboe named lands and divide the same between them and pay (unreadable) to the girls such sum or sums as will make all of my children equal share and share alike.

(Item) And whereas my youngest sons Travis MCLAURIN and Hill C are minors now therefore my will and desire is that my wife Quinny Ann is hereby constituted and appointed guardian of these two children to have and take the custody and guardianship both of their respective persons and estates untill (sic) shall severally (sic) arrive at the full age of Twenty one years of age.

And lastly, I do hereby constitute and appoint my beloved wife my lawful executrix to all intents and pruposes to execute this my last will and testament according to the true intent and meaning of the same.

In witness where of I the said Temple CRANFORD do hereby set my hand and seal this the 24th day of March A.D. 1871

Signed sealed and declared by the said Temple Cranford to be his last will and testament in the presence of us who at his request and in his presence do subscribe our names as witnesses thereto - day and date above written.

A paper purporting to be the last Will and Testament of Temple CRANFORD deceased is exhibited before me, the undersigned, Judge of Probate for said County, by Quinny Ann CRANFORD the executrix therein named, and the due execution thereof by the said Temple CRANFORD by the oath and examination of AG MUDACH & Daniel RUSSELL the subscribing witnesses thereto : who being duly sworn, doth depose and say, that he is a subscribing witness to the paper writing now shown to him, purporting to be the last Will and Testament of Temple CRANFORD That the said Temple CRANFORD in the presence of this deponent subscribed name at the end of said paper writing, which is now shown as aforesaid, and which bears the date of the 24th day of March 1871. And the Deponent further Saith, That the said Temple CRANFORD the testator aforesaid,  did at the time of subscribing his name as aforesaid, declare the said paper writing so subscribed by him and exhibited, to be his last Will and Testament, and this deponent thereupon subscribe his name at the end of said Will, as an attesting witness thereto, and at the request, and in the presence of the said testator.   And this deponent further saith, that at the said time when the said testator subscribed his name to the last Will as aforesaid, the said Temple CRANFORD was of sound mind and memory, of full age to execute a Will, and was not under any restraint to the knowledge, information or belief of this deponent, and further these deponents saith not.

In the matter of the Will of Temple CRANFORD}

Before B.B. BULLA Judge of Probate

(Blank)  being duly sworn doth say:

That Temple CRANFORD late of said County, is dead, having

first made and published his last Will and Testament; and that,

Quinny Ann CRANFORD is the Executrix named therein.

Further that the property of the said Temple CRANFORD

consisting of Personal and Real estate is worth about $2000.00

so far as can be ascertained at the date of this application and

that Quinny Ann CRANFORD widow, M.M. CRANFORD

MS CRANFORD LT. MCLAURIN, HK CRANFORD of

Randolph Count, NC two to (next two words unreadable)

CRANFORD & H K CRANOFRD are minors (unreadable)-

C.T. ANDREWS wife of Joran L. ANDREWS of Texas are

the parties entitled under said Will to the said poperty.

Sworn to and subscribed before me, this 18th day of November,

1871}

I Quinny Ann CRANFORD do solemnly swear (or affirm) that I

believe this writing to be and contain the last Will and testament of

Temple CRANFORD, deceased; and that I will well and truly

execute the same by first paying his debts and then his legacies, as far

as the said estate shall extend, or the law will charge me; and that I

will well and faithfully execute the office of an executor, agreeably to

the trust and confidence reposed in me, and according to law; so help

me God.
