This Indenture made and entered into this ____ day of November 1828 Between Samuel IRELAND, John L FOREE and Polly FOREE his wife, William HAYS, Thomas P COATES, David Lawson LUCKETT and Huldah his wife, Joseph THOMASSON and Patsy his wife, Henry S LAWSON and Milly his wife, Betsy BARTLETT and Mariam BARTLETT, the said Samuel IRELAND haveing intermarried with Nancy BARTLETT late daughter of James BARTLETT deceased the said William HAYS haveing intermarried with Susan BARTLETT late daughter of the said James and the said Tho P COATES haveing also intermarried with Lucy BARTLETT late daughter of the said James and the said Mariam BARTLETT being the widow of James M BARTLETT deceased late son of the said James, and the said Polly FOREE, Huldah LUCKETT, Patsy THOMASSON, Milly LAWSON and Betsy BARTLETT being daughters of the said James BARTLETT decd and all heirs of said decedant of the first part and Moses ATWOOD of the the Town of New Castle and County of Henry of the second part Whereas the said James BARTLETT in his life time was seized and possessed amongst other property of a certain tract or parcel of land situated lying and being in the said County of Henry on the waters of Drennons Lick creek and Little Kentucky containing one hundred and fourteen acres and three roods part of Innis’s three thousand seven hundred and fifty acres and the said Children of James BARTLETT haveing agreed on certain commissioners for the purpose of settling their equal proportion in the estate of said James BARTLETT deceased agreeably to the provision of the last will and testament of the decedant when the said tract of one hundred and fourteen acres and three roods of land fell by lott to Rebecca BARTLETT the wife of said Moses ATWOOD and the said Moses ATWOOD having since the division aforesaid intermarried with the said Rebecca. Now this Indenture Witnesseth that the said party of the first part for and in consideration of the premises the division aforesaid and for the further consideration of the sum of One dollar to each of them in hand paid the receipt whereof they do hereby acknowledge have and by these presents do give grant, bargain and sell unto the party of the Second part the said tract of land containing as aforesaid one hundred and fourteen acres and three roods and bounded as followeth Beginning and in a line of John RUSSELL now Hiacum BEAZLEY thence with said line N 41 ¼ West 95 poles to a sugartree White Oak and beech Original corner to John RUSSELL thence South 55 W 24 poles to a White oak and two beech in Innes’s line thence with said line N 42 ¼ W 98 poles to a sugartree sapling and three beech corner to BEAZLEY, OWEN and LOGAN thence with LOGANs line S 69 ¼ W 46 poles to three beech on a branch corner to LUKETT thence with his line S 12 E 172 poles to two beech in BARTLETTs line and corner to said LUCKETT thence with said BARTLETTs line N 70 ½ E 163 poles to the Beginning with all and singular the appurtenances thereunto belonging or in any wise appertaining. To have and to hold the said tract or parcel of land unto the said Moses ATWOOD and his heirs and assigns forever and the party of the first part covenant and agree to and with the party of the Second part that they will warrant and defend the said tract against themselves and their heirs and all persons claiming under then - But it is expressly understood that the party of the first part only sells and conveys their and each of their Interest in the said land and are not bound if the said land should be lost by any adverse claim or title. I Edmund P THOMAS clerk of the County Court for the County aforesaid do certify that this deed from the heirs of James BARTLETT decd to Moses ATWOOD was on this 15th day of December 1828 produced to me in my office and acknowledged by Samuel IRELAND David L LUCKETT, Joseph M THOMASSON Henry S LAWSON John L FOREE and Elizabeth BARTLETT parties thereto to be each of their acts and deeds for the purposes therein set forth and on the same day Mary H FOREE wife of said John L FOREE and Patsy THOMASSON wife of the said Joseph M THOMASSON, came before me in my office and they the said Mary H & Patsy being examined by me privily and apart from their said husbands declared that they did freely and willingly seal and deliver the said writing and wished not to retract it and acknowledged the sd writing again shown and explained to them to be each of their acts and deeds and consenteth that the same may be recorded. And on the 7th day of February 1829 Thomas P COATES a party to the foregoing Indenture came before me in my office and acknowledged the same to be his act and deed for the purposes therein set forth. And on this 4th day of May 1829 Huldah LUCKETT wife of sd David L LUCKETT and Mildred LAWSON wife of said Henry S LAWSON came before me in my office and they and each of them being examined by me privily and apart from their sd husbands declared that they did freely and willingly seal and deliver the sd writing and wished not to retract it and acknowledged the sd writing again shown and explained to them to be each of their acts and deed and consenteth that the same may be recorded. Whereupon the sd deed together with the foregoing certificate hath been duly admitted to record in my office. Given under my hand this 4th day of May 1829.
