Jefferson County, Kentucky Deed Book Q, pp. 202-204. This indenture made this twentieth day of February one thousand eight hundred and eighteen between James BARTLETT and Rachel his wife of the County of Jefferson and State of Kentucky of the one part and Nimrod DORSEY and Columbus DORSEY of the county and state aforesaid of the other part witnesseth that the said James and Rachel his wife for and in consideraton of the sum of one hundred and twenty eight dollars and twenty five cents current money of the United States of America to them in hand paid the receipt whereof they do hereby acknowledge have granted bargained and sold aliened release enfeoffed conveyed and confirmed and by these presents do grant bargain and sell alien release enfeoff convey and confirm unto the said Nimrod and Columbus and to their heirs and assigns a certain tract or parcel of land lying and being in the county and state aforesaid on the east branch of the waters of Floyds fork part of the tract on which the said BARTLETT now lives containing twelve acres and three quarters of an acre of land with all the appurtenances be the same more or less and bounded as follows to wit -- Beginning at a shelbark hickory near said BARTLETTs fence and with the course of the same S 10 west forty five poles to a hickory and small poplar in a line of James BARTLETT and John BURTON Junior and with the same north seventy west seventy two poles to a beech [in] said line near a small branch, thence with the meanders thereof north fifty four east forty four poles to a beech black oak and buckeye near said branch, thence south eighty six east thirty eight poles to the beginning -- And all the estate right title interest claim and fee of the said James BARTLETT & Rachel his wife of in and to the said tract or parcel of land with the appurtenances to have and to hold the same unto the said Nimrod and Columbus and to their heirs and assigns to their only proper use and behoof forever - And the said James and Rachel his wife do covenant and agree to and with the said Nimrod and Columbus and with their heirs and assigns that they the said James and Rachel his wife are seized of a good sure and perfect estate in fee simple of in and to the said tract or parcel of land with all the appurtenances that they have full power and lawful authority to sell and convey the same to the said Nimrod and Columbus and to their heirs and assigns and that they the said James and Rachel his wife will and their heirs exe’ors and adm’ors shall warrant and forever defend the said tract or parcel of land with all the appurtenances unto the said Nimrod & Columbus and to their heirs and assigns forever against all and every person or persons whatever lawfully claiming or to claim the same -- And the said James doth covenant and agree to and with the said Nimrod & Columbus and with their heirs and assigns that they shall at all times and forever have the right to cut out and keep open thro’ his the said James land on the line between him and John BURTON Jun. and which line runs towards Wm CANEs & nearly an eastwardly course, a road of sufficient width for a waggon to pass along and may freely use the same forever and at all times as any public road and the said Nimrod & Columbus do covenant and agree to and with said James and with his heirs and assigns that he the said James & his heirs &c shall forever and at all times hereafter have the right to cut out and open a road of sufficient width for a waggon to pass along between a line of the land of said James and of the said twelve & three quarter acres to be as freely used by said James his heirs and assigns as any public road -- In witness whereof the said James and wife have hereto set their hands and seals on the day and year first written.
Sealed & delivered } I the clerk of the County Court of Jefferson County in the State of Kentucky do certify that on this day the above named James BARTLETT and Rachel is wife came personally before me in my office and acknowledged and delivered the above and foregoing deed as and for their act and deed - That I examined the said Rachel privally and apart from the said James her husband and having shewn and explained the said deed to her she again acknowledged and delivered the same deed as and for her act and deed and declared she had done so of her own free will and consent and without the threat persuasion or coercion of her said husband and was willing the same deed should be recorded and did not wish to retract her said acknowledgement and that I have recorded the same deed in my said office -- Witness my hand this 9th day of April 1819.
