This indenture made this 10th day of June one thousand eight hundred and five between Daniel MCCLELLAND Esquire as late Sheriff of Shelby County in the State of Kentucky of the one part and John MILLER Esquire, Frederick GAGER and Adam HOKE all of Jefferson County in the same state of the other part whereas a Fieri Facias issued the 14th day of May 1802 from the clerks office of the late Court of Quarter Sessions of Jefferson County in the name of Thomas BULLITT against Frederick BARTLETT for £19"8 debt with 15 per centum interest per annum thereon from the 9th day of May 1801 till paid and four dollars and thirty two cents [costs]. Also another execution issued from the said office on the 20th day of May 1802 in the name of Mildred NABB administratrix of Charles NABB dec’d against the said BARTLETT for £17"8"2 debt with 15 per centum interest per annum thereon from the 15th day of January 1801 till paid and five dollars sixty five cents costs and also one other execution issued from the same office on the 16th day of June 1802 between and in the name of the said parties for £15"14"6 debt with 15 per centum interest per ann. thereon till paid from the 10th day of February 1802 and five dollars sixty five cents costs, all three of which executions were endorsed that no security should be taken, were directed to the Sheriff Shelby County and delivered to the said MCCLELLAND as such amounting in the aggregate to sixty six pounds 16/4 and whereas the said BARTLETT being seized and possessed of a tract of two hundred and twenty eight acres of land, part of a larger tract of seven hundred and fifty acres granted to William BARTLETT, situate lying and being in the said County of Shelby on the waters of Floyds fork the said MCCLELLAND took the same in execution by virtue of the process aforsaid and the same being within the settlement and due notice given to the said BARTLETT and the sale duly advertised the said MCCLELLAND Sheriff as aforesaid sold the same on the premises according to law (in the presence of said BARTLETT) to the said MILLER as the highest bidder for himself and the said GAGER and HOKE for the amount of the said executions. Now therefore this indenture witnesseth that the said Daniel MCCLELLAND for and in consideration of the premises and the said sum of £66"14"4 current money to him in hand paid the receipt whereof is hereby acknowledged hath as late Sheriff of the said County of Shelby granted bargained and sold and as late Sheriff of the said County of Shelby doth by these presents grant bargain and sell unto the said MILLER, GAGER and HOKE and their heirs and assigns forever the said 228 acres of land which are bounded as follows/ Viz, Beginning at an elm thence North twenty degrees West one hundred and forty eight poles to a sugartree and beech in the original line and corner to John BARTLETT, thence with his line North seventy degrees East two hundred and forty six poles to two beeches in the eastern boundary of the original tract, thence South twenty degrees East one hundred and forty eight poles to a beech and sugartree, thence South seventy degrees West two hundred and forty six poles to the beginning to have and to hold the said 228 acres of land with all the appurtenances unto the said MILLER, GAGER and HOKE and their heirs to their only proper use benefit and behoof forever. But it is agreed and these presents are made and accepted on this condition that the grantor his heirs ex’ors adm’or or securities are not to be answerable at law or in equity for the validity or sufficiency of the title of the said 228 acres of land or to refund the purchase money or any part of it the same being paid over to the plaintiff in the said executions and it being the intention of the parties to vest in the grantees Frederick BARTLETT’s title to the premises in tesimony whereof the said Daniel MCCLELLAND as late Sheriff as aforesaid hath hereto set his hand and seal on the day and year first written.

This indenture of bargain and sale from Daniel MCCLELLAND as Sheriff of Shelby County to John MILLER, Frederick GAGER and Adam HOKE was this day acknowledged by the said Daniel MCCLELLAND Sheriff as aforesaid to be his act and deed whereupon the same is admitted to record.
