QUITCLAIM DEED

This Indenture made the fourth day of January in the year of our Lord One thousand Eight hundred and two, between Humphrey MARSHALL of the one part and William BARTLETT of the other part. Witnesseth that the said Humphrey MARSHALL for and in consideration of the sum of five shillings to him in hand paid by the said Wm BARTLETT at and before the sealing of these presents the receipt whereof the said Humphrey MARSHALL doth him acknowledge, hath granted bargained and sold, alien and confirmed, and by these presents doth grant bargain and sell, alien and confirm unto the said William BARTLETT his heirs and assigns forever, all the rights title claim, interest property and demand of the said H MARSHALL by virtue of a deed from Robert MORRIS who held by Deed from William BELL to whom a Patent Issued for the Land, of, in and to the following tract or parcel of Land, Containing twelve Hundred Acres, be the same more or less, and bounded as follows Viz, Begining for the same at a Sassefras, Gum and Oak being a corner of the original Survey for 2500 Acres, thence So. 45 E 480 Poles to a Stake, thence No. 45 E 400 Poles to a Black ash and Hickory and White Oak, thence No. 45 West 480 Poles to two Hickories and White Oak, thence So. 45 West 400 Poles to the begining in the County of Nicholas. with its appurtenences, to have and to hold the said tract or parcel of Land with its appurtanances to the only use and behoof of him the said William BARTLETT his heirs and assigns forever as in full and ample manner as the said MARSHALL MORRIS or BELL did or Could hold the same by virtue of the deeds and Patent aforesaid And the said Humphrey MARSHALL and his heirs the said tract or parcel of Land to the said William BARTLETT his heirs and assigns from and against the Claim of the said MARSHALL the said MORRIS the said BELL from and against the claim of all other claiming or to claim from by through or under them or other of them, shall and will warrant and forever defend by these presents, But it is expressly hereby covenanted and agreed by and between the said H. MARSHALL and the said Wm BARTLETT, that the said H. MARSHALL and the said Wm BARTLETT, that the said H. MARSHALL and his heirs are not to Warrant or defend the aforesaid tract or parcel of Land, from or against any other claim or claims whatsoever than those above expressed, and that the said William BARTLETT hath and hereby doth expressly take upon himself all Risk and loss whatsoever that has or may happen, bi or ...... by means of any Original interfering claim whatsoever therwith, or with any part thereof, Saving neverthe less the said sum of five shillings, which the said Wm BARTLETT to pay, as a full and compleat compensation and indemnity, for and or amount of all and every damage, loss or injury of whatever kind or nature ..... the same may be, by reason of or on account of any and every and all, and all manner of Suits, Actions or recoveries, had sought, obtained, or suffered for, or on account of any and every & all and all manner of Original interfering claim or claims therewith, or with or with any part of the aforesaid tract or parcel of Land hereby sold and conveyed whenever the said five shillings shall be demanded, or tendered as the one or the other shall first happen or take place, and that no suit or action of any kind wahtever other than for the aforesaid five Shillings, shall ever be moved or commenced, sued prosecuted or Maintained by the said William BARTLETT his Heirs or assigns against the said H. MARSHALL and his Heirs or assigns for any Money or other thing paid and received, or agreed to be paid and received for, or on account of the aforesaid tract or parcel of Land, but the same shall be will and truly paid at all and in any event whatever, IN Witness whereof the said H. MARSHALL hath hereunto set his hand and seal the day and year first above mentioned–

I Joseph MORGAN Clerk of the Court of quarter Sessions for the County aforesaid, do certify that this Indenture of Bargain and Sale from Humphrey MARSHALL to William BARTLETT was produced in my office, and acknowledged by the said Humphrey before me according to Law, and duly Recorded
