Jefferson County, Kentucky Deed Book Y, pp. 279-281. This indenture made this twenty sixth day of May one thousand eight hundred and twenty six between James BARTLETT of the County of Jefferson and State of Kentucky of the first part and Richard BRANHAM, George P. BARTLETT and William HARDIN of the county and state aforesaid of the second part witnesseth that the said party of the first part for and in consideration of the sum of one dollar to him in hand paid by the party of the second part the receipt whereof is hereby acknowledged have granted bargained and sold and by these presents doth grant bargain and sell alien release enfeoff convey and confirm unto the said parties of the second part and to their heirs and assigns forever one certain tract piece or parcel of land lying and being in the county of Jefferson and State of Kentucky containing one hundred and sixty acres be the same more or less it being the same tract of land whereon the party of the first part now resides, also one half acre lot number twenty three lying in Middletown and in the county aforesaid, also one half acre lot number twenty two (22) in Westport, also two head of horses, six head of horn cattle, thirty head of hogs and twenty eight head of sheep and two bed bedsteads and furniture, one sugar disk [desk?] ?__an and table furniture and one dining table, half dozen chairs together with all my household and kitchen furniture, also one negro man named Essex, one boy named Bob, also one waggon and gear with all my farming utensils belonging to and in possession of the party of the first part and all the estate right title claim interest and fee of him the said party of the first part and in and to the above described land lots and other property above mentioned with all the appurtenances and every part and parcel thereof unto the party of the second part and to their heirs and assigns to have and to hold the before described property unto them the party of the second part and their heirs and assigns to their only proper use benefit and behoof forever and the said party of the first part doth covenant and agree to and with the party of the second part that he will and his heirs executors and administrators shall warrant and forever defend the before described property both real and personal with all the appurtenances and every part and parcel thereof unto them the party of the second part and to his heirs ex’ors adm’rs or assigns against all and every person or persons whatsoever claiming or to claim the same provided however, and these presents are upon this condition, that whereas the said Richard BRANHAM and William HARDIN stand bound as security for the said James BARTLETT in a note given by the said BARTLETT to the president and directors of the Bank of the Comonwealth of Kentucky at Louisville made due and payable the day of for five hundred dollars and the said George P. BARTLETT stands bound as the security of the said James BARTLETT in a note given by the said James to William LUNSFORD for fifteen hundred dollars made due and payable on the day of and the said Richard BRANHAM is also bound as security for the said James BARTLETT to different and divers persons for about three hundred dollars. Now if the said party of the first part shall well and truly fray off and discharge the aforesaid notes when they respectively fall due and in all cases to indemnify and save harmless the said parties of the second part in consequence of their becoming security as aforesaid, then this conveyance and every matter and thing herein contained shall cease determine and become utterly null and void and the property herein and hereby conveyed shall revert to and revest in the party of the first part in as full and ample manner as to all intents and purposes as if this conveyance had never been made and executed. But it is perfectly understood by and between the parties to these presents that the said party of the first part is to remain in possession of the property hereby conveyed rent free and pay all public dues and taxes thereon and to enjoy the rents issues and profits thereof until divested of the possession by and under the power and authority of this instrument of writing, [the words "endorses and" stricken out before signing]. Witness I Worden POPE clerk of the County Court of Jefferson County in the State of Kentucky do certify that on this day the foregoing deed was produced to me in my office and acknowledged and delivered by James BARTLETT, a party thereto, to be his act and deed and that I have recorded the same in my said office. In witness whereof I have set my hand this twenty sixth day of May one thousand eight hundred and twenty six.
