JAMES BARTLETT to WILLIAM HERN

This indenture made this twenty seventh day of February in the year of our Lord one thousand eight hundred four between James BARTLETT of the County of Shelby and State of Kentucky of the one part and Willam HERN of the County of Madison and state aforesaid of the other part witnesseth that the said James BARTLETT for and in consideration of the sum of ninety nine pounds three shillings and nine pence lawful money of Kentucky to him in hand paid, the receipt whereof he doth hereby acknowledge, hath granted bargained sold aliened and confirmed and by these presents do grant bargain sell alien and confirm to the said William HERN his heirs and assigns a certain tract or parcel of land containing one hundred thirty two & one fourth acres lying and being in the County of Shelby on the waters of Floyds Fork it being part of a tract of seven hundred and fifty acres of land pattented in the name of William BARTLETT father to the said James and devised by the said William to his son James which is bounded as follows (to wit) Beginning at a sugartree and beech corner to James CRANE, thence north twenty west with BARTLETTs original line to Frederick BARTLETTs corner in said line and with Frederick BARTLETTs line and James CRANEs line south seventy west an equal distance on both of the last mentioned lines for quantity and it is hereby understood and fully agreed on by the parties that the said BARTLETT sells the above mentioned land on a specialty only warranting William BARTLETTs title to said land and if any claim should hereafter prove better to the said land than the said BARTLETTs or if the said HERN should be legally evicted by any title that may hereafter prove better than said BARTLETTs in that case the said BARTLETT is to repay the said HERN the above sum of ninety nine pounds three shillings and nine pence with interest from the twenty second day of February one thousand seven hundred and ninety eight which is the time he received said money of said HERN to have and to hold the said tract or parcel of land with all and singular its appurtenances to the said William HERN his heirs and assigns forever to his and their only proper use and behoof and the said James BARTLETT for himself and his heirs the said tract of parcel of land with its appurtenances to the said William HERN his heirs and assigns against the claim of the said BARTLETT & his heirs the said one hundred thirty two and one fourth acres of land do and will warrant and forever defend in witness whereof the said James BARTLETT and Rachel his wife hath hereunto set their hands and seals the date above written.
