Jefferson County, Kentucky Deed Book R, pp 449-450 This indenture made and entered into this twelfth day of June one thousand eight hundred and twenty between Jacob FRIETLY & Elizabeth his wife of the County of Harrison and State of Indiana of the one part and Joseph BARTLETT of the County of Floyd and state aforesaid of the other part witnesseth that the said Jacob FREETLEY and Elizabeth his wife for and in consideration of the sum of four hundred and eighty dollars to them in hand paid the receipt whereof is hereby acknowledged and the said Jacob FREIGHTLEY and Elizabeth his wife do hereby bargain & sell and by these presents do hereby grant bargain and sell and confirm to the said Joseph BARTLETT his heirs &c all that tract or parcel of land lying and being in the County of Jefferson & State of Kentucky and on the waters of Cain & Brush run and bounded as follows Beginning at two sugar trees and a small walnut sapling, thence S 184 ½ poles to a maple sugar and elm on Henry TAYLORs line, thence S 85 W 61 ½ poles to a beech and sugar tree corner to James CARMICLE, thence N 15 W 32 poles to three sugartrees in James MERRIWETHERs original line, thence S 78 W 70 poles to an ash elm and walnut sampling, thence N 120 poles to two beeches, thence E 119 poles to the beginning including one hundred & ten acres be the same more or less with all and singularly its appurtenances unto the said Joseph BARTLETT and his heirs forever and the sd. Jacob FREIGHTLY and Elizabeth his wife doth hereby bind themselves their heirs &c to refund the aforesaid consideration money without interest provided the said land should be taken by any other claim but is to warrant and defend sd. land from those claiming in or by him the said Jacob FREIGHTLY and his wife but no further - In testimony whereof the said Jacob FREIGHTLY and Elizabeth his wife have hereto interchangeably set their hands & seals the day & year first above written.
Signed sealed & delivered I the clerk of the County Court of Jefferson County in the State of Kentucky do certify that on this day the above named Jacob FREITLY and Elizabeth is wife came personally before me in my office and acknowledged and delivered the foregoing deed as and for their act and deed That I examined the said Elizabeth prively and apart from the said Jacob her husband and having shewn and explained the said deed to her she again acknowledged and delivered the same deed as and for her act and deed and declared she had done so of her own free will and consent and without the threat persuasion or coercion of her said husband and was willing the same deed should be recorded and did not wish to retract her said acknowledgement and that I have recorded the same deed in my said office Witness my hand this 12th day of June 1820.
