      Pg. 214/8: (earlier procession recorded 27 May 1822), Sketch of land; In pursuance of an ordered rendered by the county clerk at their June 1823 term on the application of John M. Duncan appointing us Benjamin J. Yane, Thomas Worrall?, and William Berkley commissioners to procession two tracts of land belonging to said Duncan, part of an original tract of 1680 acres that was entered, surveyed and pattented in the name of William Thermion? and agreeable to a notice herewith filed that was published in the western monitor at Lexington, we the aforesaid commissioners and Thomas Hart surveyor of the county, met at the dwelling house of said Duncan on 19 Aug. 1823 and then proceeded to settle? the Beginning corner of a tract of 150 acres whereon the said Duncan now resides which was conveyed by deed from John Payne and wife Betsy to said Duncan, being attended by James Kelly and Clark Thomson, disinterested persons residents of said county; at the beginning the commissioners caused a stone to be planted with the letters JMD engraved thereon which bears S-W 4/10 poles from a walnut remarked with one additional chop above the old corner marks, James Young and Joseph Kelly who claim land adj. being present and said Young admitted stone to be in a line of his land and the Kelly also admitted said stone as being at a corner of his land; from there extending according to the call of said Duncan ... west ... to a stone ... admitted by Joseph Thomson being present to be in a line of his land, said to be a corner of a tract of land belonging to Frederick B. Nicholas, and shewn by Joseph Kelly whose deposition is taken to perpetuate testimony as being at or near the spot where the corner was made between the surveys made for McDonalds and Duncan; from there extending south the calls aforesaid ... corner to Frederick B. Nichols; from thence extending pursuing the calls of said Duncans Deed ... planted a stone ... admitted by Griffin Kelly to be line of his land whereon he now resides and is said to be corner to Frederick B. Nichols land; from thence pursuing the calls of Duncans deed with said Kellys line ... Griffin Kelly admitted as a corner of his land; from thence ... All the lines of the above mentioned survey we remarked by adding one additional chop (on a tree) above the old marks thereon except ... (no date) Wit. James Kelly, Clark Thompson, Benjamin M.       7-386: 12 May 1810, agreement between Samuel Arnett son of Thomas Arnett decd of Clark Co. KY, with Aaron Burson and John Duncan of Loudon (sic) Co. VA; that Aaron Burson and John Duncan produced to Samuel Arnett a copy of the will of Samuel Arnett decd late of Loudon Co. VA, dated 18 Dec. 1809, duly proved in County Court of Loudon, VA, on 18 Jan. 1810, whereby it appears that Samuel Arnett of KY is entitled to receive a legacy from the estate of Samuel Arnett decd supposed to be about $450 out of the personal estate of decedent; now the said Samuel Arnett son of Thomas has sold his interest in the personal estate of said Samuel Arnett decd. to said Aaron Burson and John Duncan with the understanding that if the amount Samuel Arnett of KY is entitled to does not exceed $450 arived (sic) from the personal estate of sd. decedent and cash which sd. decedent might of had laid out or deposited in the hands of any person or which may be in the hands of sd. decedents executors for the sum of $300, the 1/2 paid the ballance to be paid on or before 12 Nov. 1811; and Burson and Duncan agree that in case the legacy above mentioned does not amount to $450, that Samuel Arnett of KY is not to refund any part of the said $300 above mentioned; and Burson and Duncan further agree with Samuel Arnett that if on examination into the amount of the legacy it shall not amount to $450 that they will not plead in bar to the last payment of sd. $300 as it is expressly understood that Burson and Duncan give Arnett that sum of $300 for his chance of the money that may be had of the estate of sd. Samuel Arnett decd and arising from the personal estate which Saml. Arnett of KY may be entitled to by sd. decedent's will; Aaron Burson and John Duncan further agree with Samuel Arnett that if the legacy ... shall amount to more than $450 that Burson and Duncan will receive the same in as speedy a manner as nature of the case will admit and as soon as ... they will pay to Arnett two thirds of what money shall be recovered over $450, Burson and Duncan retaining the other one third; nothing herein construed as to affect any interest Samuel Arnett may be entitled in any landed estate. Weaver, and Julia Ann Ragland, Jemima Ragland, Elizabeth Ragland, Absalom Ragland and Alfred Ragland, children of Polly Ragland decd, all their right and title in a tract of land in Clark Co. on the waters of Stevens Fork of Licking River, whereof the said decedent died possessed, and which was granted by patent to John Stevens decd, and for which lands said decedent held a bond on James Duncan dated Oct. 18, 1817. Said tract beginning corner to Jacob Wilson in Benjamin Harrison's east boundary, thence southwest, which bond as executed by James Duncan to said decedent, Absalom Hanks decd, was for $1,620, conditioned that Duncan would convey to Hanks a deed for the said land, containing about 50 acres, on or before Sept. 1, 1819.
