1. Zaccheus TOBEY was born on 7 Jul 1757 in Dartmouth, Bristol, Massachusetts. He died on 2 Aug 1839 in Caton, Steuben, New York and was buried in Elmwood Cem., Caton, Steuben, New York. [Parents]

BIRTH: The only evidence I can find of his birth is page 15 in a document by Emily Dunn Vandenberg and FLorence Dunn on file at Cooperstown. It states he was born 7/7/1757 in Bedford, Mass (Bible Record). Where is this bible record? His birthdate is mentioned in Christopher Tobey's bible. Zaccheus' father is blank although lists a Mary as his mother, but the birth and death date are the same as Deborah Taber Tobey. Probably is filled out by Christopher from memory. However, he DOES remember his grandfather and grandmother's name--unless he was copying from an old paper. In any case, it is obvious he does not know his grandparents names. This seems strange considering that they lived in Butternuts with REv. Tobey there at the same time. Zaccheus (b. 1757) also named his oldest child Taber (could be Deborah's maiden name). Also has a son Amaziah (names after his brother? Elnathan's son?) This in addition to the letter received from Amaziah Tobey stating the death of his mother.

Dartmouth marriage record states Zaccheus 3d Toby married to Mary Gifford. Well, there were already two Zaccheus' in town. THey could have simply referred to him as the 3d. This was often done (for instance our Amaziah (2nd) was not a "Jr". It is probably from this record that the Tobey Genealogy surmised that Zaccheus (b. 1757) is the son of Zaccheus (b. 1734).

RESEARCH TO BE DONE: Check birthdates of children. Some appear to be wrong.

BIOGRAPHY: Moved from Bedford, Bristol County, Mass in 1781 to Conway, Mass, 100 miles west of Boston, Mass. 1790 Census, there was a Zaccheus Tobey listed in Conway, Hampshire County, Massachusetts. From 1795 to 1797 he was at Charlton, Mass, 57 miles west, southwest of Boston. From 1802 to 1829 he lived in Butternuts, Otsego County, New York. 1829 to 1836 Thompson, Penn. 1836 to 1839 in Union, Broome County, New York.

Revolutionary War Service: In Massachusetts Soldiers and Sailors of the Revolution is listed Zaccheus Tobey, Private, Capt. Manasseh Kempton's Co., Col. Freeman's Regiment, enlisted Sept 27, 1777, discharged Oct 29, 1777, service 1 mo 4 days at Rhode Island on a secret expedition. Roll sworn to in Bristol County.

(from Tobey-Hill records) Fall of 1776 for 3 months in Capt. Menossa Kemptons Co., Col. John Hathaway's. Served Massachusetts stationed at Hawlands Ferry near Rhode Island for one month in January 1777.

NOTE: letter from Levi Tobey to Christopher Tobey in Union, Broome Cty, New YOrk, dated Friday morning half past five oclock August 2, 1839: Respect Brother: I hasten to inform you that our dear father is no more. He was taken with a chill about ten 0'clock yesterday which lasted about an hour. He then sunk down into a calm sleep and continued to sink away calmly until 27 minutes past three this morning when his happy spirit took its flight to mansions of bliss without struggle or a groan. Let me die the death of the righteous and let my last end be lik his. Such is the state of his mortal remains that we have thought it advisable to bury him tomorrow at one o'clock. We are all well.

Zoeth Tobey of the town of Butternuts in said county of Otsego to me personally known to me the identical person herein mentioned and described being by me duly sworn according to law, doth depose and say that he is acquainted with Zacheus Tobey of the town of Thompson, County of Susquehannah and state of Pennsylvania, and late a resident of the town of Butternuts in said County of otsego. That this deponent is seventy five years old and was born in Bedford, in the country of Bristol, in the State of Massachusetts. That he has known and been acquainted with Zacheus Tobey/ also a native of the said town of Bedford/ since and ever since he was a small boy and that said Zacheus has always reputed to be about one year older than this deponent. That said Zacheus enlisted with this deponent into the service of the State of Massachusetts at Bedford aforesaid for three months to serve in the neighborhood of Rhode Island. That they enlisted in the fall of 1776 or 1777 being the fall before the capture of Burgoine at Saratoga and that they served together for said term of three months in Captain Manassa Kempton's Compny in Col. John Hathaway's Regiment. That, George Clagan was Kempton Lieutenant and Thomas Cash 2nd Lieut. or Ensign. That they the said Zacheus and Zoeeth were stationed at or near Rowlands ferry in the vicinity of Rhode Island and were discharged at or near that place at the expiration of said three months. That they did not receive any written discharge. That this deponent does not recollect the name of the commanding officers under whom he served excepting those whose names are above mentioned. That in the fall of the year in Spencer's expedition against the British forces then in possession of Rhode Island and that he served one month and a part of said month this deponent served with said Zacheus and that they were both discharged at the end of the month at or near Howland's Ferry aforesaid. That said Zacheus did not at any time serve as a substitute for any other person to the knowledge of this deponent.

On the ______day of ______personally appeared before the holden in and for the Said county of Susquehanna, Zacheus Tobey, a resident of the town of Thompson, in said county of Susquehannah, aged seventy six, who being first duly sworn according to the law doth on his oath make the followin declaration in order to obtain the benfit of the provision made by the act of congress passed June 7th, 1832. That he enlisted into the service of the State of Massachusetts in the fall of the year 1776 or 1777 or in the month of January 1777 or 1778. That he enlisted and was called into service aforesaid at or near Howland's ferry that he enlisted and served under Captain Manassa Kempton whose under officers were George Clagan Lieutenant and Thomas Cash second Lieutenant or Ensign and whoe Colonels name was John Hathaway of Freetown in the County of Bristol in the State of Massachusetts. That the said Zacheus enlisted for the term of three months and served the whole of said time on his own account and never served as a substitute for any other person. That he was born in Bedford in the said County of Bristol and resided there at the time he enlisted and was there called into the service, that he lived since the revolutionary war in Massachusetts but for the most of the time he has lived in Butternuts Otsego County New York and for the last three years in the town of Thompson in the State of Pennsylvania. That in the fall of year in which Burgoine was taken he volunteered in what was then called Spencer's expedition again Rhode Island or against the British forces which were then in possession of Rhode Island that he served a month in that expedition under officers whose names he does not now recollect except Capt. Shubail Hall and was discharged at the end of that time near Howland's ferry. That he never received a written discharge. That he hereby relinguishes every claim whatever to a pension or annuity except the present and he declared that his name is not on the pension roll of any agency in any state or territory in the United States. That he has no written record of his age and knows of non. That he is acquainted with Paschel Franchett Volkert P. Van Ranselair Robert De Latt Collins De Latt and others in Thompson in said COunty of Susquehannah who can testify as to his character for truth and veracity and their belief of his services a soldier of the Revolution.

I certify that on this 16th day of July 1834 the persons whose names are hereto subscribed to wit Paschel Franchell, Ansel C. Moore, Luther M. Skidmore, Volkert P. VanREnsalier, appeared before me and being by me duly sworn according to law and severally for himself depose and say that he is and has been for many years well acquainted with Zacheus Tobey and Zoeth Tobey and that they are men in whose veracity they have the most implicit confidence that they should judge them to be men of about seventy five years of age and have resided in the town of Butternuts in said county of Otsego for thirty years or more. That said Zoeth is still a resident of said town but that said Zacheus has for the last few years resided in Pennsylvania as they have been informed and believe and that any statement which they may make under oath or otherwise is entitled to credit and belief.

Subscribed and sworn before me this 16 day of July 1834, E. Dewey a Justice of the peace of said County of Otsego.

Zaccheus married 1 Mary GIFFORD, daughter of Peleg GIFFORD and Abigail SHEPHERD, int. 9 Jan 1778 in Dartmouth, Bristol, Massachusetts. Mary was born about 1757 in of Dartmouth, Bristol, Massachusetts. She died on 28 Jul 1837 in Union, Broome, New York and was buried in Bridge St. Cem., Endicott, Broome, New York.

BIRTH-DEATH: George N. Hill records. She is buried in Union Presbyterian Cem. near the tool house, Endicott. Died 7/28/1837 in her 80th year.
