Hi everyone,
Here is something for those of you, who like I, are descended from John
Burgess. It's a record I found a couple of years ago and just found
again.

For and in consideration of the sum of one dollar to
each of us is handpaid and the further consideration of the division of
the land of John Burgess, late of said county deceased we the
undersigned heirs and distributers of said John Burgess dec'd have this
day granted and sold unto Smith Burgess all of our right, title,
interest, claim, and _____? and to the following tract or parcels of
said land to wit: the SW 1/4 of Section 18 and the NW 1/4 of Section 17
and the SE ?? of SE ?? that of part of SE 1/4 of Sec. 7 belonging to the
estate of of said John Burgess dec'd all in T 11, Range 1. Each to have
and to hold unto him the said Smith Burgess heirs and assigns forever.
In testimony whereof we hereunto set our hands and seals this the 14th
day of September 1878, also all the land that belonged to said John
Burgess dec'd lying in the NE 1/4 of of SW 1/4 of Section 7 in T 11
Range 1 East except 7 acres where Jane Hendricks resides. In testimony

I hope some of you find it as interesting as I did when I first
discovered it. The signees are all the living children of John Burgess
Jr. and the girls husbands. It provides a lot of good information. I
wish they had these kind of records over in Cherokee Co. AL. It would

Here are a couple of short articles I wrote about Jabe and Mary Ann:
Jabe Alexander BURGESS, 11 Apr 1844 - 3 Mar 1926 - He was born at Cave
Spring, Floyd County, Georgia. His parents were William and Mildred
BURGESS. He was one of thirteen children.
At age 19, he enlisted in the Confederate Army as a Private. While
serving with Co. K, 19th Alabama, was wounded in a battle in Atlanta,
Georgia, 28 Jul 1864. He was home on furlough at the time of the
surrender in 1865. In Nove 1994, there was a special ceremony at the
Glenwood Cemetery, by Sons of the Confederate Veterans honoring him for
his Civil War service.
He married Mary Ann Hartline at Alpine, Cherokee County, Alabama, 3 Mar
1870. They had six children:
Will, Dave, Vina, Taylor Lee (my grandfather), Emma and
John A. BURGESS.
In the late 1880's, they moved to Fort Payne, DeKalb County, Alabama,
they lived in Rising Fawn, Dade County, Georgia prior to this. After
their move to Fort Payne in the 1880's, they lived near the intersection
of Hwys. 11 and 35 where there is now a WalMart Shopping Center
located. A story relayed to me by a cousin, is that a little creek near
their home, washed their little house away and the family woke up during
the night, and barely kept from getting swept away by the flood, but a
kerosene lamp had continued to burn as the house floated down the hollow
until the house crashed. Then the light went out and left the family
homeless. Of course, this was a flash flood.
After this incident, the family moved to the Cunningham farm which was
always called the "Flat Woods." This was located off Hwy 35, where
Hardees Restaurant is now located. This is where the mailbox set.
K-Mart is across the highway. They later moved to Valley Head, DeKalb
County, AL, where they lived until Jabe's death in 1926.
Due to the early death of his son-in-law, Will McKinney, his daughter,
Emma, moved back home with her children, Mary and Bud and he helped to
raise these grandchildren. Also, his son, Taylor Lee, was hit by a
train and died at an early age so he and Mary Ann helped to raise
Taylor's three children, Charles, Clara and Wesley (my father).
Jabe is buried at Glenwood Cemetery, Fort Payne, DeKalb County, AL
beside his wife, his sons, Taylor, Dave and John and a number of other
relatives. (His wound from the Civil War became infected and was known
to be the cause of his death.)

BURGESS, Jabe A., :Present Post Office address: Ft. Payne; b. April ll,
1845 at Cave Springs, Ga. in Floyd Co.; first entered the service as a
private in Jan. or Feb., 1864 at Dalton, GA (which is also in Floyd Co.)
in the Co. K 19th Ala. and continued until wounded at Atlanta, Ga. July
28th, 1864. Was at home on furlough at surrender in 1865.
Mary Ann HARTLINE (BURGESS), b. 1 Apr 1854 - 26 Jun 1937, She was born
at Alpine , Cherokee County, AL. She was the daughter of George
Washington Hartline and Nanct D, Mobley.
There was another child, Alice. Granny (Mary Ann) had the measles when
her little daughter was born and Alice died. (This info came from a
granddaughter (the daughter of Vina). Nothing more is know about Alice
at this time.
Mary Ann's brother, Alec, is the great grandfather of four of my LYONS
cousins (my mother's family)and the grandfather of Ella Hartline LYONS,
wife of Samuel Luther LYONS, my mother's oldest brother.
Haven't learned yet where Mary Ann lived after the death of Jabe, but
probably with one of her children as they lived in Fort Payne at that
time. She is buried beside her husband at Glenwood Cemetery, Fort
Payne, DeKalb County, AL. (I have visited their graves several times.)
I will prepare a genealogy report from my Family Tree Maker program and
forward it to the group later.

Hello Christopher,
Very good to hear from you. I am married to Linda Fay Thomas for 36
years. She is a direct descendant of Stephen Smith Burgess 1832-1911
through his 5th child daughter Electer Adeliza Burgess 1869 - 1952. I am
helping her and her father, Leonard Clayton Thomas research their Burgess
family. They have a book by Harl Donald Burgess and Dr. Elbert Felton
Johnston that is very good with minor errors and a few blank spots as they
all do. One thing that is missing is the location of where John Burgess,
Sr. is buried. They know where Jr. is but it has concerned Leonard for
many years that he does not know where Sr. is buried.
We live in Dacula, Ga. but Leonard was raised around Culman Co. and Blunt
Co. AL. We have lots of family around Hollypond and Hanceville AL>
