The Last Will and Testament of Jacob Gindlesperger,
The English Translation by Jacob Huber, According to the following "Account with...[the] Executors"
I Jacob Guindelsperger Living in StoneyCreek Township Somerset County in the State of Pennsylvania make herewith the Twenty Seventh day
of September in the Year of our Lord and Saviour Jesus Christ one thousand Seven hundred and ninety Eight My Last Will and Testament, so is my Last will and Testament as follows:
1st I order myself to God and his Community, he will be my Pilot from now to Eternity.
2nd Among My Executors Shall Bury me according to the Christian Rules. 3(sic) My left Widow Barbara Guindelsperger Shall keep my Whole Estate in her hands without Taking of an inventory and may keep house with my children as long as she or the Executors may think it good. 4th When they then will quit houseKeeping I Then bequeath unto my left Widow the House Clock and of the Movable property as much as she pleases and one Hundred Pounds in Money, this Hundred Poundsthe Executors shall keep in their hands and give her when She Stands in Need. She must take her Movable property before the Inventory is made. I also bequeath unto her a Widow Seat on the Spring House, My two oldest sons must finish it, A petition, a Chimney, and Stairs inside to the Spring and the Pipe ["Yeipe" 1]
Stove that stands therein is to Stay there. The Joiner and the Mason is to be paid out of the Movable property. and a piece of the Garden she Can take where She pleases and that
must be manur'd (sic) every Year and one Quarter Acre of Land She can Choose where she will which they must "manure Yelow [sic, yellow] and harvest what she may plant and <she may keep what> she Pleases, and one row of apple [no space here in manuscript] [ trees she can choose." 2 Yearly,
the fire Wood must Be made and Delivered Before the House and Yearly, Eighty Weight Pork, twenty Pounds of Beef must be given Her. She has the Right to Keep one Hog on the Plantation. She can also take
oneº& a Half Acre of Meadow where She will, which must be made and put under Roof. She Has the Right of Keeping one Cow and Two Sheep and they have the right in the Meadow and the fields where they go, and Place in the Stable for her Cow and Sheep and place on (sic) the Stable for her fother (sic, fodder?) where she [no space here in manuscript] [pleases, but the Sheep He must Winter that Lives on the place, and one Riding Mare He must keep in fother [fodder] as one of his own and Can use her as his, but when the Mother wants her he must Sadle (sic) her without Delay. There must also be given to her Yearly Six Bushels Wheat, Six Bushels Rye and Six Bushels of Oats, the Wheat and Rye must be Deliver'd ground with the Brand (sic, Bran) ["Deliver'd" repeated and scratched out] at Her House and if it [no space here in manuscript] [Should Happen that she Could not Work nomore (sic) then He who lives on the place, must do her Work, as is Right, all the above Named Articles must be Noticed and paid as long as She lives or is a Widow the place may be Occupied By an Heir or a Stranger, But if She Marys [sic, marries] She is to get fifty Pounds and her Widow Seat is Null and Void, and Leave the place ------------
5th When the Mother has Taken her Movable Property then the Executors Shall Make an Inventory of the Movable Property, the grain in the field, Excepted which stays with the Place, and Shall put the [end of first manuscript page] Last Testament and Inventory in the Register's office, and keep a Publick (sic) Sale, But Should there be a time that they think it best to Sell or Divide the Moveable Property among the Children, they Shall then do what they think Best.
6th I Bequeath my Plantation, Deed and Buildings that Stands (sic) thereon with a piece of Warranted Land To my two Sons Christian and Joseph Guindelsperger and their Heirs or Afsigns for Ever. 7th My Executors Shall Devide (sic) my land in two Equal parts by a Surveyor then they shall take two men to them and apprize (sic) the land at a Reasonable Price in Money and make the payments according as the times may be, then Each of them must pay Half of the Widow's ºSeat and do Half the Work one like the other, what Ever the place is Worth more Where the Build= =ing is on, must pay so much more that the other that moves in the Woods, then When the Hundred Pounds is paid to my Widow from the Movable Property I Bequeath four Pounds for Alms, and Sixteen Pounds to my Executors for their Trouble, and When all my Debts are paid, then all to be added into one Sum and made into Six Equal Parts, Each as much in Value as the other, my two Sons Christian and Joseph Guindelsperger, Each of their Shares Deducted out of their Land and for the "Remainder they must give their Bonds or <...>as the Executors thinks (sic) Proper" 3 then the Executors must make the Devidend (sic) or payments to my four Children as they Come Due from the place, But if my two sons Should be Contentious and Will not agree as the Executors makes it, then the Executors may sell the place on publick Sale or Lease it or Sell it, it is in their Will as they may think it best, and the Hundred pounds they Shall Keep in their Hands, and give to my Widow when she wants it,. Now my Executors have my Whole Estate in their hands and See my Will, But if there Should give a time and See that my Will was Not Good, they have the Authority from me to do as they think Best, or if one or the other Article is not plainly Written so that a Contention Should Arise Between my Heirs, then my Executors Shall Stand and Say the Word and as they Say it, my Heirs Shall be Satisfied. Than (sic) their word Stands as fast as if I had personally Spoken it, no man Can overthrow their Word or alter it. 8th I Elect and Set my friends John Stutzman Living in Brothers Valley Township, and John Yoder Living in Stoney Creek Township, Executors of all my Estate and give them Rights and Authority to Collect and pay Debts, to Sign or Convey [whatever] it may be Bill A Sale (sic) or Deeds, Notes or Bonds or what Name it Has that wants an Afsignment
and with the Same Authority as if I had done it written proper [? in] my own Hand all the above Mentioned my Executors Can do or any one of them, This is my Last Will and Testament and undersign it with my own hand and Seal by Witnefses.
