The Hushers lived in Chillicothe before going to Breckenridge. Husher, when he first came to Chillicothe, advertised as a magnetic healer. Finding small demand for magnetism here he later went to selling breakfast food which found a readier market. Samuel HUSHER was born in 1815 in France. He died on 12 Feb 1862 in Livingston Co., Missouri. Samuel Husher lived adjacent to John Volk and was hung for killing a neighbor. On the 31st of August, 1861, William Avery was waylayed and murdered by Samuel Husher, near the residence of the latter in Jackson Township, a mile east of Spring Hill. There was a neighborhood feud existing in the community between Avery and Husher and others. It was on a Saturday evening and Avery was on his way to the house of a neighbor for a sack of corn. Samuel was in ambush and when Avery came opposite fired upon him with a shotgun and killed him instantly.

A sort of informal venire of twenty four good and reputable citizens was returned and Husher was allowed to choose from among them twelve men to serve as his jury. The trial came off at Spring Hill before this jury and two magistrates. Very strong and convincing testimony was produced. Everything was done fairly but promptly. No injustice was shown to the prisoner. The jury did not deliberate long: their verdict was brief and emphatic -- guilty! Their sentence was severe but satisfactory -- death by hanging within the next 24 hours!
