This is dated 22 Nov 1910. Will of J. H. Carter

I, J. H. Carter, of Audrain County, Missouri, being mindful that life is uncertain do make and publish this my last will and testament as follows:

First - I give and devise to my beloved, wife, Martha A. Carter, all of my property of every kind and wheresoever situated both real estate and personal property of every kind to have and to hold and to use with the power to sell, mortgage or convey as she may think best after the payment of all my just debts and funeral expenses and costs of settling my estate. If my said wife should die owning any of the property given her by this my last will, which she has not used or disposed of, it is my will that said remainder of my estate be divided by her equally among our five children, Effie J. Dalby, Wenona Squires, Charlotta Thomas, Maude Beatty and Claude C. Carter, and the colored woman, Rose Carter, which we have raised from childhood. I wish her to have an equal share with our children because of her faithful services to our family. If any of my said children should die before my wife, leaving no descendants, then his or her share in said remainder shall be divided among the remaining children. If said Rose Carter should die before my wife, then she is to have no part in said remainder.

Second - I hereby appoint my wife, Martha A. Carter, executrix of my estate and request that she be permitted to act without bond. If possible I request that my estate be closed without any administration.

In witness whereof, I have hereunto subscribed my name at Mexico, Mo. This November 22nd, 1910.

Your Effie must have married the Thomas between 1913, when mother died and 1923 when father died. I checked in Audrain--nothing. Also Claud died before final settlement and without descendants. Cindy

Balance left to distribute: $2732.31 distributed as follows: 1/4 to Wenona Squires, 1/4 to Effie Dalby Thomas less note of $109.00 owing said estate, 1/4 to Maude M. Beatty less the sum of $106.06 Blythe note to be transferred by Admrs. to her, 1/4 to Rose Sears less the sum of $34.40 heretofore advanced by Admrs. to her.
