John Saunders, Judge of the Supreme Court of New Brunswick was b. 1 Jun 1754, Princess Ann Co, Virginia, d. 24 May 1834, ae 80 yrs, Fredericton, York Co, NB, bur. Old Burial Ground, Fredericton, s/o Jonathan Saunders.
He m. ca. 1789, England, Arianna Margaretta Jekyll Chalmers, b. ca. 1868, Maryland, d. 1845, ae 77 yrs, Fredericton, York Co, NB, bur. Old Burial Ground, Fredericton, d/o Col. James Chalmers. He raised & commanded the Maryland Loyalist in 1777 / or Col Henry Chalmers ?They had three children.

John Saunders, 4th Puisne Judge for New Brunswick, b. in Virginia. The Earl of Dunmore, Gov. General of Virginia called for support against the Revolution. John Saunders immediately obeyed and was made a Capt. even though very young, and raised a Company and saw first battle at (or near) Great Bridge. He was twice wounded during the rebellion. At end of rebellion he went to England aboard the frigate "Dionede" with all the invalids of the army, where he arrived in Dec 1783. He returned to his law studies, entered the Middle Temple, and was called to the degree of Barrister.
In 1790, he was appointed an assistant Judge of His Majesty's Supreme Court of Judicate of New Brunswick. This commission giving him the same powers and duties as those of the Judges of the Kings Bench, Common Pleas, and the Barons of the Exchequer in England.
(Letter sent to Lieut-Governor Carleton, re his Judgeship on 8th April 1790) Before leaving for NB, Judge Saunders, then in his thirty-sixth year, m. Miss Charters, receiving with her 5000 £, and 300 £ during her life. After their marriage they lost no time moving to NB.
Judge Saunders chose Fredericton as his home. Took his seat on the Bench in February term and lived many years at his home at Prince William, called "The Barony".

A letter, dated 7 Jan 1823 to Major General Smith, Lieut-Governor, approved the appointment of Judge Saunders as Chief Justice of NB.

Judge Saunders d. 24 May 1834 at his residence at Fredericton in the 80th year of his age. He attened court on the 12th and 13th of May much against his families wishes, thinking him too ill and fatigued. He replied "I must do my duty" which sentiment seems to have been his guiding principle. He is buried at the old cemetery in Fredericton, and a massive monument is erected with the following inscriptions ...
"Sacred to the memory of Honorable John Saunders, D.C.L., Chief Justice of NB who was born June 1 1754 and d. May 24 1834 at Fredericton. On the commencement of hostilities between Great Britain and her American Colonies, relinquished the academical studies of his youth, he repaired to the Royal standard with a troop of dragoons raised at his own expense. Being subsequently transferred to the Queens Rangers, he was engaged during the whole of that unhappy conflict in the most arduous and dangerous service, in which he was twice severely wounded, and was present at most of the general battles; and the cavalry and flank companies of the detachment being placed under his command, preformed numerous brilliant successful achievements. At the conclusion of the first American War he returned to the land of his ancestors, entered at the Middle Temple, and was called in 1787 to the English Bar. In 1790 he was appointed one of the judges of the Supreme Court of NB where in 1832 he was elevated to the dignity of Chief Justice and president of His Majesty's Council. Endowed with a well informed and cultivated mind, a discriminating and sound judgement and strict integrity of purpose, he heard with patience, weighed with deliberation, and decided with firmness; a staunch defender of the hereditary perogatives of the Crown, he was not less regardful of the constitutional rights of the subject.

was zealously conservative of the civil and religious institution of the monarchy. Distinguished for his patronage of agriculture and liberal education, his unaffected hospitality, and his uniform attention to the charities of domestic life, he left to his descendants a good and worthy name. and to his fellow colonist the example of nearly sixty years devoted with unspotted faith to the honor and interests of his King and country.
Erected 24th Nov 1837 by his affectionate widow A.M.J. Saunders. This monument is also intended to comerate the many virtues of Eliza Chalmers Flood, who was born on the 25th of May 1794, at Fredericton, and died on the eighth day of Jan 1821. She was the daughter of John Saunders, Esq, late Chief Justice of this colony, and president of His Majesty's Legislative Council of NB, and wife of R. Flodd, Esq. Lieutenant and Adjutant of the 74th Regiment of British Infantry. She was during her youth and obedient and dutiful daughter, and during her more mature years a kind and affectionate wife, and her conduct while in this dreary abode of mortality showed her to have been possessed of all that can render human life truly happy by Christian piety and genuine virtue."

Judge Saunders had two sisters. They m. Colonel Elligood and Major McKay, half-pay officers residing in York County, NB. His wife d. 1845, at Fredericton ae 77. Leaving a daughter, wife of Hon. George Shore; and a son, Hon. John Simcoe Saunders.

In 1818, John Saunders Ellegood, Capt. 55th Regt of Foot, at present stationed in the Isle of Jersey, sold the lot to George Shore who also acquired all the Waterloo Row acreage once owned by Col. Ellegood. J.S. Ellegood was the second son of Col Jacob Ellegood and had been a merchant in Fredericton before he joined the army. Capt. George Shore (104th Regt) was appointed Adjutant General of Militia in NB in May 1821 and also a member of H.M. Legislative Council. In 1823 appointed Clerk of the Plea. He held all three until his death in 1851. His wife, Margaret Saunders, was cousin to John Saunders Ellegood.

Hon. John Saunders bought the property at the lower north-eastern extremity of the Town Plat, first granted to Stephen Jarvis (near the Cathedral).
John Saunders and his wife had three children.

Youngest daughter, Eliza Chalmers, m. Capt Rodd Flood (of 74th Regt)
Only son, John Simcoe, b. 1795. He read law in England in the office of Joseph Chitty, the well known legal writer.
When Eliza d. she left an infant son, John Saunders Flood, who was brought up by his grandparents.
Margaret & George Shore turned over their property from her father to their eldest daughter, as a marriage settlement in 1851, when she m. Richard Theodore Pennefather, private Sect. to Lieut-Governor Sir Edmund Head.
The Pennefather's removed tp Toronto with Head in 1854. Several years later she returned to her Fredericton home as a widow and lived there with her son Richard, a law student.

When Judge Saunders d. in 1845, John Saunders Flood fell heir to a lot of property of his grandparents. He soon departed for England where he studied medicine and his NB property was sold (p.136, sold some in 1851 - mentions John Saunders Flood in England as a medical student.)

In 1798, Judge Saunders bought "Island Farm" Kingsclear,and a stone house was erected there, apparently by his son-in-law George Shore, after retiring from active service about 1820.
Mrs. George Shore lived in Kingston and Quebec while he was on active duty with the 104th Regt.

John Simcoe Saunders (Hon) (1795-1878)
York County / His Majesty's Executive Council / MLCJohn Simcoe Saunders was born 13 Jul 1794, at "The Barony", Prince William, York Co, NB. Of Colonial-English-Loyalist ancestry. Only son of the Hon. John Saunders (qv), Judge of the Supreme Court of New Brunswick, and a distinguished Loyalist officer; and his wife Ariana Margaretta Jerkyl Chalmers, daughter of Col. Chalmers, London, England.
Educated at the local school, and at Oxford Univ., England. Studied law in London, England, with the celebrated Joseph Chitty, Esq. and was admitted to the Bar of England, as an Attorney, 18 February 1817, as a Barrister, 18 Feb 1819. Admitted to the Bar of Lower Canada, 1820.
Returned to New Brunswick in 1830, and located at Fredericton, York Co, where he engaged in the practice of his profession. Received appointment of Master of Rolls, and also that of Justice of the Peace, and Justice of the Inferior Court of Common Pleas for York County, and Sunbury County.
Married, ... , to Miss Elizabeth Sophia, daughter of Rev. George Storie, Rector of Stowe Maries, Essex, England. By this marriage there was a famiy of two sons and one daughter.
On February 11th, 1833, he was appointed a member of the Legislative Council and continued a member of that body until his decease. He was President of the Legislative Council from 1866 to 1878.
On February 11th, 1833, he was appointed to the First Executive Council of NB, as one of the five members, and assumed the position of Advocate General. He held this position until February 5, 1846. He was also Surveyor-General from 1840-1843; Provincial Secretary, 1845-1848. Also Clerk of the Circuits, 1840-1867.
He died, July 27, 1878, at his residence, Fredericton, NB, aged eighty-three years. Buried in the Family Lot, Old Cemetery, Fredericton, NB. Survived by his widow, one son and one daughter. Mrs. Saunders died, October 17, 1879, aged seventy-eight years.
