RELEASE: Sam'l McGuire & David Cook to James McGuire

This indenture made the nineteenth day of March in the year of our Lord eighteen hundred and thirty nine between Samuel McGuire and Martha his wife and David Cook and Nancy his wife (which said Samuel and Nancy are children and heirs of John McGuire late of Derry Township, Westmoreland County in the State of Pennsylvania deceased of the one part and James McGuire of the county and state aforesaid of the other part. Witnesseth that the said Samuel McGuire and Martha his wife and David Cook and Nancy his wife for & in consideration of the sum of four hundred & sixty dollars to them in hand paid the receipt whereof is hereby acknowledged they the said Samuel McGuire and Martha his wife and David Cook and Nancy his wife have granted, bargained and sold, and by their presents do grant, bargain and sell, unto the said James McGuire, his heirs and assigns all their right, title, interest and claim of in and the real estate of which the said John McGuire died seized & possessed in Derry Township on the county and state aforesaid adjoining lands of Isaac Hughes and other containing two hundred acres be the same more or less. To have and to hold the tract or parcel of land and premises and the estate right title and interest of them the said Samuel McGuire and Martha his wife and David Cook and Nancy his wife of in and to the real estate aforesaid and every part and parcel thereof with the appurtenances unto the said James McGuire his heirs and assigns to the only proper use and behoof of the said James McGuire his heirs and assigns forever. In witness whereof the said parties of the first part have hereunto set their hand & affixed their seals the day and year first above written their hands & affixed their seals the day and year first above written signed sealed and delivered in the presence of Adolf Klemm, Hugh Culbertson.

Personally appeared before me the subscriber one of the Judges of the Court of Common Appeals in and for the county aforesaid Samuel McGuire and Martha his wife and David Cook and Nancy his wife and acknowledged the above written indenture to be their act and deed for the uses and purposes therein mentioned. And the said Martha and Nancy being of full age and by me examined separate and apart from their said husbands and the full contents of the said Indenture made known unto them, they the said Martha & Nancy did upon separate Examination declare that they did voluntarily and of their own free will and accord sign and seal and as their act and deed deliver the same indenture without any coercion or compulsion of their said husbands. Given under my hand and seal this nineteenth day of March in the year eighteen hundred and thirty nine.

Before whom the foregoing acknowledgment was taken was at the date of the same one of the Acting Associate Judges of Court of Common Pleas within and for the county of Wayne and state Ohio duly elected and commissioned as such to those official acts full faith and credit as of right due so well in Courts of law so there abt. In testimony whereof I have hereunto subscribed my name and affixed the seal of said Court at Wooster the 25th day of April 1839.
