Transcript of....Will of Robert Oatridge 1752 Source: w1: Archdeaconry of Wilts Wills. (1171) Transcript: In the Name of God Amen I Robert Oatridge of the Moore in the parish of Oaksey in the County of Wilts Gentleman being weak and infirm in body but of sound and perfect mind memory and understanding Thanks be to God therefore do hereby make and Ordain this to be my last Will and Testament in manner and form following (that is to say): First I desire my body may be decently buried at the Discretion of my Executors hereinafter named Item my will is that all my first Debts and Funeral Expenses be paid and discharged with all convenient speed next after my decease by my Executors hereinafter named. Item I give and bequeath to my nephew Joseph Rogers (s/o of sister Margaret) the sum of fifty pounds to put and place him out an apprentice or to be paid and applied to him or for his ??? in such manner as my Executors hereinafter named shall think proper Item I give and bequeath to my niece Mary Handcock (d/o of sister Ann) the sum of Fifty pounds to be paid to her within one year next after my decease if she shall be then living but not otherwise-- Item I give and bequeath to my 3 sisters Mary Oatridge Elizabeth Haviland and Jane one Guinea each to buy them a ring. Item I give to my Brother John Oatridge all my wearing apparell both Linnen and Woollen or of what nature or kind soever the same may consist to be delivered to him-- immediately after my Decease by my Executor hereinafter named Item I give and bequeath unto my Dearly beloved wife Dinah Oatridge the reasonable use and occupation of all my Household Goods-- Furniture and Implements and Utensils of Household and of all my plate and Linnen for and during the term of Sixty Years if she shall so long happen to live and from and immediately after the Expiration or other sooner Determination of that Term I give and bequeath the same to my Daughter Ann Oatridge To hold to my said Daughter her Executors Administrators and Assigns for ever Item I give and devise unto to my wife all that Messuage or Tenement Stable and Tubhouse wherein my Grandfather formerly dwelt together with such parts of the garden and orchard as were usually held and enjoyed by my said Grandfather and also free use of the pump in the upper Garden at all times which said premises are part and parcell of the Messuage or Tenement-- Garden and Orchards so herein I now dwell situate at Oaksey aforesaid To Hold to my said wife and her Assigns for and during the Term of her natural life free and discharged of and from all ??ments or other ??? Taxes Charges or Incumbrances whatsoever Item I give and bequeath unto my said wife yearly and every year during so long time as she shall happen to liveTwo loads of Fire Wood to be cut off my Estate at Oaksey aforesaid of Twenty Shilliungs value each or also Forty Shillings shall be paid her yearly and every year in ?? thereof by my Executor hereinafter named Item I give and devise unto my said wife one annuity yearly ???? sum of Forty pounds of good and lawful Money of Great Britain to be ??? going and payable out of and from all and singular my Messuages Lands Tenements and Hereditaments to situate at Oaksey aforesaid other then except such parts of as herein before Given to my said Wife for her life To have hold levy ??? for ??? take the said annuity yearly ??? sum of Forty pounds unto my said wife and her Assigns for and the term of her Natural Life-- at the four most usual Feasts or Days of payment in the year (that is to say) the Feast of Saint Michael the Arch Angell the Nativity of our Lord Christ the Annunciation of the Blessed Virgin Mary and Saint John the Baptist by even and equal portions without any Deduction Defalection or Abatement for Taxes or any other matter or thing whatsoever the first payment thereof to begin and to be made on such of the said Feasts or Days as shall first and next happen after my Decease and (end of page 1 signed Robt Oatridge) if it shall happen that the said annuity yearly ??? sum of forty pounds or any part thereof shall be behind and unpaid by the grace/space? of Twenty days in ??? after any or either of the said Feasts or Days of payment wherein the same ought to be paid as aforesaid that then and so often as the same shall happen it shall and be lawfull to and for my said wife and her Assigns into and upon my said Messuages Lands Tenements and other Hereditaments and premises or any part thereof other than as aforesaid to enter and distrain for the same and the ???? of said ???? or then and there found to take carry and drive away impound sell and dispose of ??? to Save untill the said Annuity yearly ??? sum of forty pounds and the arrears thereof (if any) together with all costs and charges attending such ??? or ???? sake or sakes shall be fully paid and satisfied Item I give and bequeath to each of my Executors hereinafter named the sum of five pounds for the Trouble they shall be at making in the Trusts and Executorship hereby in them reposed Item all and singular my said Messuages or Lands Tenements and Hereditaments situate at Oaksey aforesaid and all other my Freehold Messuages Lands Tenements and Hereditaments whatsoever and wheresoever charged and chargeable never ??? with the payment of such of my Legacies as are herein before mentioned Funeral Expenses and Debts as my personal Estate shall prove insufficient to discharge I give and devise unto my Good Friends Simon Oatridge of Oaksey aforesaid Gentleman and Daniel Oatridge of Doughton in the parish of Tetbury in the County of Gloucester Cheesefactor their Heirs and Assigns for ever to for and upon the Several uses and Interests and purposes-- hereinafter mentioned (that is to say) To the use and ??? of my said daughter Ann Oatridge and her assigns untill she shall be married and from and after her Marriage Then to the use and ??? of my said Daughter Ann Oatridge her Heirs and Assigns for ever provided always and my will and meaning is that In case my said Daughter Ann Oatridge shall happen to die unmarried that then in such case my said Trustees and the Survivor of them and the Heirs and Assigns of such Survivor shall stand and be seized of all and singular my Messauges Lands Tenements and Hereditaments-- Whatesoever and Wheresoever charged and chargeable never the ??? with the payment of such of my ???? or as are herein before mentioned Funeral Expenses and Debts as my personal Estate shall prove insufficient to Discharge and also charged and chargeable with the payment of the several legacies or sums of money herein after mentioned To the use and ??? of my nephew William Butt (s/o sister Jane) and his assigns until he shall be married and from and after his marriage Then to the use and ??? of my said nephew William Butt and his Heirs and Assigns for ever provided always and my will and meaning further is that in case my said nephw William Butt shall happen to die unmarried that ??? in such cases my said Trustees the said Simon Oatridge and Daniel Oatridge and the Survivor of them and the Heirs and Assigns of such Survivor shall stand and be seized of all and singular (end of page 2) signed Robt Oatridge my Messuages Lands Tenements and Hereditaments situate at Oaksey aforesaid and of all other my Freehold Messuages Lands Tenements and Hereditaments to whatsoever and wheresoever charged and uncharged never ??? with the payment of such of my Legacies as are herein beforementioned Funeral Expenses and Debts as my personal Estate shall prove insufficient to Discharge and also Charged and Chargeable with the payment of the several legacies or sums of Money herein aftermentioned To the use and ???? of my said Trustee Daniel Oatridge and of his Heirs and Assigns for ever and To for and upon none other ???? and Intent or purpose whatsoever Item In case my said Daughter Ann Oatridge shall happen to die unmarried but not otherwise I give and bequeath unto my niece Sarah Oatridge and Mary Oatridge Daughters of my said Brother John Oatridge the sum of one hundred pounds apiece and to my nephew Jeremiah Handcock and my niece Mary Handcock (children of sister Ann) the sum of one hundred pounds apiece and to my Nephew Joseph Rogers (son of sister Margaret) the sum of one hundred pounds and to my said Brother John Oatridge the sum of fifty pounds and To my said three sisters-- Mary Oatridge Elizabeth Haviland and Jane Butt the sum of fifty pounds apiece and my will and meaning is that the several legacies last Mentioned shall be paid to the several and respective Legatees last Mentioned over and besides any other Legacy or Legacies to them or another or either of them herein before Given and bequeathed by this my Will by the person or persons who shall be entitled to my Messuages Lands Tenements and Hereditaments herein before mentioned by virtue of this my Will within one year next after the decease of my said Daughter Ann Oatridge and I do hereby charge my said Freehold Messuages Lands Tenements and Hereditaments with the payment thereof accordingly Item all the rest residue and Remainder of my Goods Chattles Rights Credits Stock and personal Estate Whatsoever and wheresoever not herein before disposed of I give and bequeath unto my said Trustees Simon Oatridge and Daniel Oatridge In Trust for them my said Trustees and the survivor of them and the Executors and Administrators of such survivor to sell and dispose of the same to the best advantage they can and by and out of the Moneys arising by such sale In Trust in the first place to pay off and discharge all my Inst Debts and Funeral Expenses and then In Trust to pay the several Legacies of fifty pounds to the said Joseph Rogers and Fifty pounds to the said Mary Handcock and the three Guineas to my three sisters and ?????? ??? to themselves the several Legacies of five pounds each to them herein before respectively Given and from and after payment and satisfaction of my Debts Funeral expenses and the several and respective last mentioned Legacies Then In Trust to pay the Overplus if any to my said Daughter Ann Oatridge and I do hereby make and appoint the said Simon Oatridge and Daniel Oatridge whole and Sole Executors of this my will hereby revoking all former Wills by me at any time heretofore made and I do hereby declare this to be my last Will and Testament (end of page 3) signed Robt Oatridge Provided always and my Will and Meaning further is that it shall anyway be lawfull to anex? for my said Trustees and the survivor of them and the Executors and Administrators of such survivor to ???? and satisfy him and themselves all Costs Charges Damages-- and Expenses which they or any or either of them shall or may ??? Expense or so put into for or an Amount of the Trusts hereby in them reposed or anything relating thereunto nor shall my said Trustees or either of them be Answerable or Accountable for any more Moneys than he or they shall actually reserve nor shall the one of them be Answerable or accountable for the acts-- Receipts or Defaults of the other of them but oath for his own Act Receipt or Default only And I do hereby make and appoint my said Trustees Guardians of my said Daughter Ann Oatridge during her minority In Witness whereof I the said Robert Oatridge have to this my last Will and Testament contained in the four sheets of paper to the three first sheets thereof sett my hand and to the fourth and last sheet thereof sett my hand and Seal this Sixteenth day of July in the year of our Lord one thousand seven hundred and Fifty Two Signed sealed published and delivered by the said testator as and for his Last Will and Testament in the presence of us who at his request and in his presence and in the presence of each other have so ?? subscribed our names as Witnesses hereto........
