Will Book #12, 1830-1834, p.94, William Womack, will - dated 21 Dec 1830, proved 9 May 1831

 

I William Womack of the county of Chesterfield do make constitute and ordain this my last Will and testament in the manner and form following: 1st I leave to my wife Elizabeth Womack the land and plantation whereon I now reside containing one hundred and ninety two acres, more or less, also one negro man named Cezar [?], one negro woman named Caty and her children, all of the cattle, horses, stock of sheep, hogs plantation utensils, one feather bed & furniture, and kitchen furniture during her natural life.  2ndly My will and desire is that my daughter Nancy C. Womack continue to live and remain in the plantation and to have free access to the dwelling house & premises free and clear of any charge during her single life.  I give to my said daughter Nancy C. Womack fifty dollars [word ???] which I desire to be raised out of my estate I have lent to my wife after her decease, I also give to her one feather bed & furniture and one milch [sic] cow.

3rdly I have given to my son Wm. D. Womack, four hundred dollars one feather bed & furniture one cow which is all I intend to give him of my estate.

4thly I have given to my daughter Mary C. Smith one bed & furniture one cow and forty five dollars.  5thly I have given to my daughter Susan Gill one feather bed & furniture & one cow. 

6thly I have given to my son Francis J. Womack one feather bed & furniture.  I also give him one cow after the death of his mother.

7th I give to my son James M. Womack one feather bed & furniture also one cow after the decease of my wife Elizabeth Womack.  My will and desire is that all the personal estate lent to my wife Elizabeth Womack after paying my past debts at her decease except the legacies already given shall be equally divided among my children namely Nancy C. Womack, Francis J. Womack, James M. Womack, Susan Gill, & Mary C. Smith, last of which named daughters I lend the share she will get of my estate after the decease of my wife Elizabeth Womack to her during her natural life, after her decease I give it to her children.

I give to my two sons Francis J. Womack and James M. Womack the land and plantation whereon I now live after the decease of my wife Elizabeth to be equally divided between them.

Lastly I do hereby constitute and appoint my worthy friends Capt. Benj. Graves and C. C. Graves my whole and [word ???] to this my last Will and testament.  In testimony whereof I have hereunto set my hand & office my seal this twenty first day of December eighteen hundred and thirty.

Will Book #12, 1830-1834, p.185, William Womack, codicil to will - not dated, presented in court 11 July 1831

 

In the name of God, I William Womack of Chesterfield County do make and ordain this my last Will and testament hereby revoking all others heretofore made.  Imprimis [Latin for “specifically”] I recommend my soul to God who gave it to me and my body to the earth to be buried in a decent and Christian like manner and as to what worldly goods it hath pleased God to bless me with I give and dispose of as follows to wit: Item.  I give unto my wife Elizabeth one third of my estate to be held by here during her life and no longer.  Item.  I give unto my daughter Nancy C. one bed and furniture, one cow, the loom with all its machinery, fifty dollars in money, to be raised from my estate, and the privilege of living in my house during her single life.  Item.  I give unto my son William D. one dollar to him, his heirs and assigns forever.  Item.  I give unto my son Francis Jefferson one cow to him his heirs and assign forever.  Item.  I give unto my son James Madison, one bed & furniture and one cow to him his heirs and assigns forever.  Item.  I give unto my daughter Susan Gill, one cow to [seems like the word “her” left out here] & her heirs and assigns forever.  Item.  It is my chosen [???] will & desire that the balance of my estate be equally divided between my children, Francis Jefferson, James Madison, Nancy C., Susan & Mary C. to them their heirs and assigns forever except my daughter Mary C. and her portion after deducting forty nine dollars I lend unto her during her life and after her death I give the same to the lawful issue [???] of her body to them and their heirs and assigns forever.

 

In Chesterfield county court July 11th 1831.  The forgoing writing was presented in court by Jordan Gill and Granville Smith for record as a codicil to the last Will and testament of William Womack deceased and for reasons appearing to the court, the proof of the same is continued till the next term, and a summons awarded against James M. Womack, Thomas J. Womack [sic, should be “Francis J. Womack”], Elizabeth Womack and Nancy Womack to cause them to appear here on the first day of the next term to show just cause, if any they can, why the said writing should not be recorded as a codicil to the said Will and testament of William Womack deceased.  And in said court August the 9th 1831 for reasons appearing to the court, the proof of the said writing was continued until tomorrow.  And in said court August 10th 1831 for reasons appearing to the court the said writing was continued till next term.  And in said court September the 12th 1831 on hearing the evidence of Edwin W. Poindexter, who was duly sworn and examined, it was considered by the court, and accordingly ordered that the said writing be recorded as a codicil to the last Will and testament of the said William Womack deceased in relation to his personal estate.

ABSTRACT: Dated 1832 [month and day not given].  “An appraisement of the estate of Suckey Womack decd.”  Estate consisted of 1) One feather bed and bedstand, 2) Bed clothing, 3) Earthenware, 3) one pot & hook [???], 4) 2 small chests, 5) 3 chairs, and 6) 1 table; total value $18.75.  Appraisers: Charles E. Graves, William E. Gill, Archd Franklin Senr.  Recorded 11 Feb 1833.

ABSTRACT: Sale on 23 Oct 1832.  “Account of sales of the estate of Suckey Womack decd.”  Sold by Silas Cheatham.  Buyers were 1) Owing Smith (4 items), 2) William E. Gill (1 item); 3) Eleazer Crostick (5 items), 4) Archer Franklin (2 items). Total: $14.21.  Recorded 11 Feb 1833.

In Obedience to the annexed order of Chesterfield county court we the undersigned commissioners have divided and allotted the estate of the late Wm Womack deceased as follows, to wit: We allot to Nancy C. Womack a negro boy (John).  We allot to Polly C. Smith two children (Martha and Sam).  We allot to Francis J. Womack a negro boy (Daniel).  We allot to Susan Gill one negro girl (Eliza).  We allot to James M. Womack a negro woman named Cate and her increase to be retained by Mrs. Elizabeth Womack until after her death, clear of any charge by either party, and then to go to James M. Womack with her increase.  Each legatee have received their bed & cow.  Miss Nancy C. Womack received fifty dollars which was also allotted her.

In the name of God Amen I Elizabeth Womack of the County of Chesterfield being weak in body but of sound mind thanks be to God for the same do make constitute and ordain this my last will and testament as it hath pleased Almighty God to bless me with a few worldly good I shall dispose of them in the following manner. Viz 1st I recommend my soul to God who gave it and my body to the earth to be buried in a decent and Christianlike manner and after paying all my just debts.  2nd I give devise and bequeath unto the Children of my son William D. Womack all the money remaining of my estate.  3rd I give and bequeath unto my granddaughter Elizabeth Gill two Counterpins two lauletts [?] one Iron pot and one dutch oven and also two sheets to her and her heirs forever.  My will and desire that my son William D. Womack receive the money given to his children for their benefit.  Lastly I do hereby appoint Samuel Taylor and Thomas Smith hole [sic] and sole executors without security to this my last will & testament revoking all others heretofore made.  In testimony whereof I have hereunto set my hand and seal this 28th day of May 1842.

In Chesterfield County Court October the 9th 1848 The last Will and testament of Elizabeth Womack deceased was produced in Court and proved on the oath of A. Franklin a subscribing witness and the hand writing of William H. Clayton the other subscribing witness was proved by the oath of Wm E. Gill and Benjamin W. Gill and ordered to be recorded.

On motion of Samuel Taylor one of the executors therein named who entered into bond without security none being required, conditioned as the said directs, and took the oath prescribed by law.  Certificates granted him for obtaining probate thereof in cice [?] form.

Pursuant to an order of the Chesterfield County Court bearing date the 2nd day of November 1849 I have examined Stated and settled the accounts of William O. Smith administrator de bonis non with the Will annexed of William Womack decd and find a balance due the estate this day of $228.56 to be divided into five equal parts and assigned to the several legatees making the sum of $5.71 to each as follows to wit:

To the heirs of Francis J. Womack decd do - $45.71

To Mrs. Mary C. Smith do - $45.71

To Wm O. Smith & wife in her right do - $45.71

It will be seen by reference to the account between the administrator and the Estate of James M. Womack decd that the administrator is indebted to the last mentioned Est in the sum of $8.96 only, and to Mrs. Mary C. Smith in the sum of $11.59.  The items of debit are supported by good vouchers.

This account embraces the whole estate except about the sum of $36 not yet collected the amount of which is not yet ascertained.

Womack dec on the 31st December 1850 of $9.70, a Balance due the by the said admr to Mary C. Smith on the last mentioned day of $9.71 ½ , a Balance due Peter F. Adams and Mary F. his wife in her right as a distrubutee of Francis J. Womack decd who was a distribute of Wm Womack decd on the said 31 Dec 1850 one cent.  A Balance due to Wm Henry Womack a distribute of the said Frs J. Womack Estate who was a distribute of Wm Womack Estate on the said 31st Dec 1850 of sixty one cents and a Balance due John Hill as the Guardian of Lavinia Womack a distributee of Frs J. Womack Estate who was a distribute of Wm Womack Estate on the said last mentioned date of twenty six cents.  The admr holds in his hands four sevenths of $55.42 ½ due to the infant children of Frs J. Womack decd him having no [p.201] guardian to receive the same and also $55.42 ½ as assignee of Jordan Gill & wife and also a like sum in his own right.
