This Indenture made & entered into this fourteenth day of Dec in the Year of our Lord one thousand Eight hundred and thirteen Between Benjamin Bryant of the State of No Carolina & County of Buncombe of the one part & Alexander Wammock of the state of Tennessee and County of Cocke of the other part Witnesseth that the sd Benjamin for & on the consideration of the sum Five hundred and & forty five dollars to him in hand paid by the said Alexr Wamock & he hath Bargained Sold ??? Released & confirmed unto him the sd Alexander a Certain Tract or parcel of land Containing Three hundred acres more or less situate and lying & and being in the Sate of No Carolina in the County of Buncombe be situate lying and being as follows on the Norh Fork of Mills River near above the fork of sd River Begining on a Red Oak near a White Oak on David Millers corner on the N East of his Bottom thence East Eighty poles to a stake thence south two hundred poles tocrossing the River to a stake thence West two hundred & seventy poles to a stake thence to the Begining. Including the Improvement where Jesse Anderson did live the samne containing two hundred acres & conveyed to sd Benjn Bryant by? Joseph Hughey & originally Granted to David Miller Also one Hundred Acres of Land lying and being in the State and County above named lying & being on the west side of French Broad River on the waters of Mills River Begining on a stake ans stump on the North side of the North Fork of said River on an improvement made by Jesse Anderson sd stump formerly the begining ??? or corner of the land that Jesse Anderson conveyed to said Benjamin Bryant running with sd line East seventy poles to a stake thence North one hundred & sixty poles to a stake thence west one hundred & Eighty two poles to a stake ??? line of land granted to David Miller thence with sd line South forty five East Two hundred & twenty fives poles to a stake thence East three poles to the Begining. To hold? unto the said Alexander his heirs & assignees forever Together with all the woods waters mines minerals hereditaments and appurtenances unto sd land or lands belonging ot the ??? appertaining and the said Benjamin doth hereby also covenant & Bind himself his heirs Exers and amrs To Warrant Mantain & forever Defend all & singular the ??? of sd unto the sd Alexander his heirs Exrs admrs & assigns against the lawfule claim of a indefearible? right of ??? ??? & in Testimony whereof the sd Benjamin Hath thereunto interchangeably set his hand and affixed his seal the day & date above written.

Will of John Womack, Sr., deceased
I, John Womack, Sr., of the county of Chatham and state of North Carolina, being in a feeble state of health, but of sound mind and memory, and wishing during my natural life, to direct the manner in wchich I wish my property to be distributed after my death, do constitute and ordain this my last will and testament in the following manner, viz. First, I give and bequeath unto my son James Womack, fifty dollars. I also give and bequeath unto my daughter Rebecca Burt, fifty dollars. I also give and bequeath unto my son John Womack, fifty dollars. Also, I give and bequeath unto my daughter Nancy Burt, fift dollars. And I give and bequeath unto my son Green Womack, all the land of which I am now possessed in three separate tracts, in all containing two hundred and twenty-three acres. And lastly, I want the balance of my property of whatever kind or description, to be sold to highest bidder, and the proceeds, after paying my just debts should I owe anything, to be equally divided between my five above named children, share and share alike. Now, I, John Womack above named, having on mature reflection, directed the above distribution of my effects in this my last will and testament, do constitute and ordain my son John Womack, Jr., sole Executor to carry the provisions of same into effect, with which provisions I wish no one to interfere or intercept after my death. In witness wherof, I hereunto set my hand and seal this 14th day of April 1848.

The petition of Patsey Womack Brittain Womack Tempie Womack William Womack Alexander Womack Molly Womack Meridth Womack Nancy Womack Ferebee Womack Winny Womack and Britain Womack (the younger) by his Guardian and next friend Thomas Barham against Wiley Womack.

Humbly complaining Sheweth to your worhips That Britain Womack the father of your Petitioners and of the defendant named in this Petion died sometime in the year Intestate possesed of a large personal Estate leaving your petitioners and the defendant Wilie Womack as his Heirs and representing that the said Wilie Womack applied to and did obtain from the County Court of Chatham letters of Administration on the Estate of the said Britain Womack deceased; that in pursuance of said letters the said Wilie Womack entered upon and took the estate of the deceased into his possession.

Your Petitioners further Sheweth to your Worships that the time allowed for the retention of the effects of the estate of said deceased in the hands of the said Wilie Womack the Administrator has sometimes since expired; that since the expiration of which time your petitioners have repeatedly called on the said Wilie Womack to account with and pay over to them their respectful parts or shares of the Estate of the said Britain Womack deceased or so much therof as in equity and good conscience they may be entitled to: not withstanding the said Wilie Womack hath refused and doth refuse to account with your petioners - now to the end that the said Wilie Womack the Administrator may account and pay to your Petioners their distrubutive shares or so much as shall appear to be due your petioners

Your petioners parays your worships to direct a copy of this petition together with the States writ of Subpoena commanding him to appear and the next court of Pleas and quart sessions to be held for Chatham County on the 2nd Monday of Novembver then and there to answer upon his corporate oath to the several matters of fact set forth in this petition and that he may be decreed to such further Equity to your petitiners as to your worships shall seem meet and your petioners as in duty will ever pray.

State of North-Carolina
Know all men by these presents, That we William Pegram George Luther all of Chatham county, in the state aforesaid, are held and firmly bound unto Thomas Farish James H Rogers and Woodson Lea

Justices of the Court of Leas and Quarter Sessions for the county of Chatham in the sum of five hundred dollars pounds, current money, to be paid to the said Justices, or the survivor or survivors of them, their executors or admnistrators, in trust, for the benefit of the child hereafter named to the tuition of the said William Pegram
To which payment well and truly be made , we bind ourselves, and each of us, each and every of our heirs, executors and administrators, jointly and severally, firmly by these presents. Sealed with our seals and dated the 12th day of August in the year of our Lord 1823.
The condition of the above Obligation is such, That whereas the above bounden William Pegram is constituted and appointed Guardian to Brittain Womack a minor orpan; now, if the said William Pegram shall faithfully execute his said Guardianship, by securing and improving all the estate of the said Brittain Womack that shall come into his possession for the benefit of the said Brittain Womack until he shall arrive at full age, or be sooner thereto required, and the plain and true account of his said Guardianship, on oath, before Justices of our said Court, and deliver up, or pay to, or possess the said Brittain Womack of all such estate or estates as he ought to be possessed of, or to such other persons as shall be lawfully empowered or authorised to receive the same and the profits arising therefrom, then the obligation to be void: otherwise to be and remain in its full force and virtue.

The Amount of the Estate of Britain Wammack Decd is as follows (To Wit).

 

There is no Estate either Real or Personal Come to my hands.  Only there appears to be about forty or fifty dollars due the Estate from his Decd fathers Estate Britain Wammack Decd^Chatham Co which sum is yet in the hands of the Admrs and not yet Collected as Guardian for the sd Britain Wammack (minor) Decd.

Wife Thuise -- my manor and plantation. Son Wyley -- 100a lying between my two plantations. Jacob my son -- all land above the road on the s side of Neil's Creek. William my son, after wife's death -- dwelling house and lan belonging to same on N side of Neil's Creek and my plantation and mill down to the creek. Benjamin my son. Daus Lucie, Sarah. Brother-in-law William Ralan. Execs. son Wyley, brother-in-law William Ralan. Wits. John Johnson, Jessie Jones and Hardy Blalock.
REB NOTE: According to Jamie R. Fish, will abstract incorrectly here, and does not actually mention wife, since something like "to my, thense" which has been incorrectly transcribed a "Thuise". Other evidence says that Benjamin's wife was Ann. There may also be a daughter, Leathy, mentioned in the will but left out in the abstract.

IN THE NAME OF GOD, AMEN.

Know Ye, that I, Thomas Wommack of the state of North Carolina, and county of Rowan, am sick and weak in Body though of perfect mind and memory do hereby constitute and appoint this my last will and testament and desire that it may be received as such by all that it may concern.  First I give and bequeath my soul to God who gave it to me, and commit my body to the dust, to be decently buried at the descretion of my Executore hereafter named in full assurance of it Resurrection from thence when time shall be no more, and as for my wordly goods, I do ordain and Constitute that all my lawfull Debts be justly paid.

And secondly I give and bequeath to my beloved daughter, Sarah Womack, my grey colt, one feather bed and furniture, one loom and the gears belonging thereto, one cow and calf.  Thirdly, I give and bequeath unto my dearly beloved children, namely, Sarah Womack, Abraham Womack, William Womack, Richard Womack, Jesse Womack, Bird Womack, Eppy Womack, all my stock of horses, cows, sheep and hogs, to be equally divided amongst said children, to have as their property, likewise I give and bequeath to my beloved sons, Abraham Womack, William Womack, Richard Womack, Jesse Womack, Bird Womack, and Eppy Womack, as aforesaid one feather bed and furniture pr piece for each of them to have as their property likewise I give and bequeath to my beloved children as before named all my other household and kitchen furniture to be equally divided amongst them to be their property likewise I give to my son Archibald Womack ten shillings to be raised out of my Estate-

And I do hereby constitute and Appoint Abraham Womack and William Womack, my true and trusty friends to be Executors of this, my last will and testament.

In witness whereof I do hereby set my hand and seal this Eighth day of October, One Thousand Seven Hundred and Ninety Nine.

IN THE NAME OF GOD, AMEN.

I, Richard Womack of the County of Rowan and State of North Carolina (farmer) being weak of body, but of perfect mind and memory, Thanks be to God for the same and calling to mind the mortality of my body and knowing that it is appointed unto all men once to die do hereby make and constitute this my last will and testament, touching my worldly Estate, Viz-I give, devise, and dispose of in the manner following, to wit,
First, I commit my soul to the care of almighty God who first give it to me, and my body to the dust from when it was first taken, the same to be buried in a decent manner-
Secondly, I will and devise that all my Just debts be paid. 
Thirdly, I will and bequeath unto my dearly beloved wife, Ruth Womack, the Land and plantation whereon I now live, to be at her will and disposal during her natural life or widowhood, and also, her choice of my Horse creatures and the two choice Cow kine, and my waggon and hind Gears with all their necessary apparatus-and as many of my Hogs as she pleases to keep-with a bear shear plow, and a shovel plow, her choice axs, and weeding hoe-together with as many other plantation and farming working tools and utensils as she may be considered to stand in need of, and also her choice bed and bedstead with a sufficiency of furniture to the same, together with as much of the other household, and kitchen furniture as she may wish to retain to housekeep with, and I wish and desire that at the death of my said wife Ruth Womack, that all the aforesaid property willed, to her to be sold and equally divided amongst my surviving children, or their lawful and bodily heirs.

Item:  I also bequeath unto my wife all my present crop now on hand together with my fattening hogs now a fattening to the use of herself and my three daughters, Nancy, Rebecca and Agnes Womack.
Item:  I give and bequeath unto my son James or his heirs, Forty four Pounds Eleven Shillings, which he has formerly received (together with a Tract of Land containing per Deed two hundred acres, which I have already Deeded)  The same to be his full share proportion or part of my Estate.
Item:  I give and bequeath unto my daughter Sally Hodge, thirty eight pounds, six Shillings, which amount she hath already formerly received.
Item: I give and bequeath unto my son Daniel Womack, forty nine pounds, nine Shillings already received.
Item: I give and bequeath unto my son Hezekiah Womack, twenty six pounds, already received.
Item:  I give and bequeath unto my daughter Edith Owen, eighty six dollars and fifty seven cents, already received.
Item: I give and bequeath unto my son Josiah Womack, one horse colt, two years old next spring, priced at forty dollars with a saddle priced at fifteen dollars in part of his legacy of my Estate.
Item:  I further give and bequeath unto my son Hezekiah Womack one bed and furniture priced at thirty dollars, one cow and calf priced at ten dollars, the same to be accounted towards his Legacy of my Estate.
Item:  I will and devise that the three remaining children, Viz, Nancy Womack, Rebecca Womack, and Agnes Womack become equal shares with the rest of my aforesaid children (James Womack excepted) and that there may be an equal distribution of my Estate among my several Heirs as heretofore expressed, and that the several amounts above received be all and severally considered as part or parts of my Estate, and that those who received nothing, and those who have received the lesser shares shall receive a proportionate part with those who may have received the greater part and that my whole children or their lawful bodily heirs have an equal division of my Estate.

Item:  I will and desire that my son Daniel Womack and my son-in-law John Hodge act as Executors on this my last will and testament and for their services receive a Just and due recompensation IN WITNESS whereof I declare this to be my last will and testament renouncing all others by me heretofore made.  This the Sixteenth day of December One Thousand Eight Hundred and Twenty.
