NOT WOMACK! Robert Warnock married Rachel Teague on
14 Mar 1852 in Benton (Calhoun) Co, AL, NOT Robert Womack. Robert Warnock was the son of Dobson Warnock and
Elizabeth Sarah Amberson (1850 Census of Benton Co, AL, p.419). This family's surname sometimes appears as Warnick, but
never as Womack. This family never left Calhoun Co, AL, and Robert and/or his widow Rachel were in every available
census from 1860 through 1910: 1860 (Robert and Rachel Warnick, p.673), 1870 (R N and Rachel Warnic, p.670),
1880 (Robert N and Rachael Warnock, p.704A), 1900 (Robt N and Rachel Warnock, p.6A), 1910 (Rachel Warnock, p.4b).
Since Robert was a Warnick/Warnock, he was most definitely not the son of Levi Berry Womack.

Prenuptial Contracts Nothing
New Polk County Enterprise - April 2005
An interesting old document filed in courthouse
records on April 4, 1846 reveals that prenuptial contracts are nothing new.
It was filed in Macon County, Alabama shortly
before a marriage was to be celebrated between John M. Marr and Catharine A.
Womack, widow of W.M.G. Womack. Catharine wanted to be certain that she would
continue to have a dependable means of support. She already had a right to one
half of everything which she and her late husband had as community property and
wanted to make sure it stayed that way after her marriage. So, the contract
assigned the community property to her own personal ownership and also assigned
to her some of her new husband's property, namely a 14-year-old slave named
Henderson and 160 acres in exchange for her becoming John Marr's bride.
John Marr, in the prenuptial contract, did hand
over all of the 160 acres and any right to obtain her property. Edwin B. Adams
was appointed to act as trustee of the properties to assure that it be used for
the support of Catharine and any children she might have by her intended, John
Marr. The property in the trust would not ever be used to pay any of John's
debts. However, John would have exclusive control and management of the property
and if he should die before there were children, control would revert to
Catharine.
If there were children born to the union, control
would be Catharine's as long as she would live, but upon her death, property
would be divided equally among the children.
The contract gave the trustee permission to sell
property from time to time and to make investments, but only with written
approval of both Catharine and John Marr.
Marr died in Polk County in 1859, leaving his
widow Catharine and a daughter Sophronia as his only heirs. That same year,
Catharine married for a third time to J. Foster Poe and, in 1860, Poe and
Catharine were named administrators of the estate of her late husband, John
Marr. Their bond before the probate court of Polk County was for $45,000.
Sophronia J. Marr did not receive her distributive
share of the estate, which resulted in numerous legal battles for many years.

William B Seay is in the 1840 Census of Franklin Co, AL (from which Colbert was formed in 1867), George "Wrather" is in the 1850 Census of
Rutherford Co, TN. Prudence (Branch) Womack may be the Prudence Womack living with William Pitman in the 1850 Census of Shelby Co, TN;
there was a William Pitman in the 1840 Census of Franklin Co, AL.
