Fauquier County Deed Book 60 pg 36 This Indenture tripartite made the 26th day of November 1866 between William H. Gaines admr. of John . Philips decd (who was a trustee in a certain deed of trust conveying certain land in trust to secure the payment of certain sums of money, from Charles J. Nourse which was for the benefit of Berkeley Ward decd) of this first part, Charles J. Nourse of the second part and Harriet Ward executrix of Berkeley Ward decd of the third part. Witnesseth that whereas on the 30th day of December 1858 a deed of trust was executed by the said Charles J. Nourse conveying to John P. Phillips as trustee a certain tract of land lying in the County of Fauquier containing Four Hundred sixty-eight acres three roods thirty-five poles 1/2 pole (for a more particular description of said land reference can be had to said deed of trust) to secure to Berkely Ward the payment of certain sums of money mentioned in said deed- And whereas the said Charles J. Nourse has long ago paid off the said sums of money as is witnssed by the signature of his executrix to this deed - Now therefore I the said William H. Gaines admr of the said John P. Phillips decd do release grant & convey unto the said Cahrles J. Nourse all the right titles & interest of the said John P. Phillips as trustee in and to the tract of land above mentioned- Witness the following signatures and seals this 26th day of Nov 1866 WH Gaines admr of Jno. P.
