FC WB 8, page 314. Last Will and Testament of George Fitzhugh. Dated 7 Apr 1818; proved 29 Apr 1823 In the name of God Amen I George Fitzhugh of the County of Fauquier being in perfect health and of sound and disposeing (sic) memory do make and ordain this my last Will and testament revoking all others. Imtpremis (sic) I give to my son Henry Fitzhugh and his heirs forever the tract of land whereon I now live containing about eleven or twelve hundred acres be the same more or less also the tract of land on which my said son now lives which I purchased of the representatives of Cole. Martin Pickett and also two hundred acreage of the tract which I purchased of Wm. Washington to be laid off in the following manner to wit beginning at a fallen poplar near the road leading across the watry mountain by a branch corner to the land purchased by my said son of Blackwell & wife and the aforesaid tract purchased of Wm. Washington running thence with the line that [illeg] that tract from the tract granted to Henderson now held by George B. Pickett up the mountain as far as will by a line from thence parallel to the back line of the said tract purchased from Blackwell & wife and extending across the said tract purchased from Washington to the opposite outer boundary include the said quantity of two hundred. Item I give to my said son Henry Fitzhugh a negro boy called Joshua and a negro woman called Alice daughter of Sal & her children and I confirm to him all the other slaves which I have heretofore given him I also give to my said son all my plantation utensils and stock of every description. Item I confirm to my son George Fitzhugh the tract of land in Culpeper which I purchased of John F. Slaughter and all the salves heretofore given him. I also give to my said son George and his heirs the residue of the tract which I purchased of Wm. Washington after taking there from the two hundred devised to my son Henry. Item I give and bequeath to my son Henry Fitzhugh the sum of one thousand pounds Virginia Currency in Trust that he shall apply the interest and proffits (sic) thereof towards the support and maintenance of my daughter Ann Baylor to her sole and separate benefit from the debts control or control of her husband during her natural life and her decease to divide the principal equally amongst her children and their representatives according to the statutes of distributions and I hereby authorize my said son his executors or admrs to invert the said sum of money in any government or Bank stock the proffits (sic) and principal of which to be disposed of in like manner as the interest and principal of the said sum is hereby directed and I do further empower my said son with the consent of my said daughter to vest the said sum of money or stock in land which shall be settled and applied in the same manner as the said money or stock is directed. I charge the payment of the sum of said hundred of the aforesaid thousand on the estate of my son Henry the remaining on the estate of my son George and they are to have the period of four years after my decease to pay the same but are to pay the interest thereon annually from my decease. There is deed to Thomas Horton a sum of money or amount of a legacy left my daughter Mary due by John Matthews this debt with its interest I direct to be paid by my son Henry and I hereby charge the estate given to him with the payment thereof. I confirm to the said Thomas Horton the slaves heretofore given him in full of the share of his late wife and her heirs in any estate I confirm to John Thornton the money & slaves heretofore given him in full of the share of his late wife and her heirs in my estate I give and release to my son Henry all sums of money which he may owe me at my decease for the vend (vent?) of my mansion house plantation or on any other account whatsoever and also all claims which I may have then against him by virtue of any contract now or hereafter entered unto I give to my brother Thomas Fitzhugh during his natural life negroes Jack and Sal the mother of Alice and Jem power him by his last will and Testament to dispose of the said slaves as he may think proper in confidence that my said brother will consult the case and wellfare of said slaves and if my said brother shall not make any disposition of the said slaves by his last will then I given them to my son Henry with a like confidence all the residual of my estate consisting of slaves horses hold (?) furniture and other things not herein before disposed of I desire may be equally divided between my said two sons Henry & George and in making the said division my will is that all the slaves which I have heretofore given or may hereafter give to either of them except the boy Joshua given to my son Henry shall be brought into Hotchpot according to the principles of the statute of distributions that is each of my sons shall be charged with the slaves given to him according to the value thereof when given and shall not be allowed for loss or liable for increase. Last I appoint my said sons Henry and George Executors of this my last will and testament. In testimony whereof I have hereunto set my head this 7th day of April 1818. Fitzhugh and Dudley Fitzhugh, and ordered to be recorded. And on the motion of Henry Fitzhugh, an executor therein named, who made oath thereto, and together with William Payne and Thomas J. Fauntleroy his securities, entered into and acknowledged a bond in the penalty of twenty five thousand dollars, conditioned as the law directs, certificate is granted to the said Henry Fitzhugh for obtaining probate of the said will in said forum (?).
