Fauquier County Deed Book 34, pages 341-342, 17 Oct 1834 Henry Fitzhugh and Henrietta Fitzhugh to Thomas Fitzhugh This Indenture made the 17th day of October 1834 Between Henry Fitzhugh and Henrietta Fitzhugh his wife of the County of Fauquier and state of of [sic] Virginia of the one part and Thomas Fitzhugh of same County and state of the other part witnesseth that the said Henry Fitzhugh and Henrietta his wife in consideration of one dollar to them in hand paid at or before the ensealing of these present the receipt whereof is hereby acknowledged, have bargained and sold and by these present do bargain and sell unto the said Thomas Fitzhugh his heirs and assigns a certain tract or parcel of land lying and being in the County and state aforesaid adjacent to a tract of land purchased by the said Thomas Fitzhugh of Whiting Diggs known by the name of Pageland beginning at a large poplar on a hill between Turkey Run and Gupton Branch on the west side of Rouges road corner to Henry Fitzhugh's conveyance to Fitzgerald and the Pageland tract and running thence N 88 W 26 poles to a stone on the outward or SW ditch thence with the said ditch N 41 W 45 poles N44 W 21 poles N 34 W 33 poles to a white oak on the west margin of the said ditch in or near a line of the Gupton tract, now owned by William Stewart, thence with the said tract N 50 E 44 poles 6 links to a white oak on a stony knob corner to the Pageland tract and the land inherited by Henry Fitzhugh from his father thence with the Pageland tract s 54 E 18 to a large white oak in a valley corner to the said Page land tract and Henry Fitzhugh, thence S 26.2 E 103 poles to the beginning containing twenty six acres one rood and thirty poles together with all and singular the appurtenances and the reversion and reversions remainder and remainders yearly and other rents issues and profits thereof and every part and parcel thereof to have and to hold the said tract or parcel of land with the tenements hereditaments and all and singular other the premises herein before mentioned or intended to be bargained and sold, and every part and parcel thereof, with every of their rights members and appurtenances unto the said Thomas Fitzhugh his heirs and assigns forever, and the said Henry Fitzhugh and Henrietta his wife for themselves and their heirs the said tract or parcel of land with all and singular the premises and appurtenances before mentioned unto the said Thomas Fitzhugh his heirs and assigns free from the claim or claims of them the said Henry Fitzhugh and Henrietta his wife or either of them, their or either of their heirs, and of all and every person or persons whatsoever shall will and do warrant and forever defend by these present. In witness whereof the said Henry Fitzhugh and Henrietta his wife have hereunto set their hands and seals the day and date first above written. Henry Fitzhugh Henrietta S. Skinker and Rice Hooe justices of the peace in the County aforesaid in the state of Virginia do hereby certify that Henry Fitzhugh a part y to a certain deed bearing date on the 17 of October 1834 and hereunto annexed personally appeared before us in our County aforesaid and acknowledged the same to be his act and deed and desired us to certify the said acknowledgement to the Clerk of the County Court of Fauquier in order that the said deed may be recorded. Skinker and Rice Hooe justices of the peace in the County aforesaid in the state of Virginia do hereby certify that Henrietta Fitzhugh wife of Henry Fitzhugh parties to a certain deed bearing date on the 17th day of October 1834 and hereunto annexed personally appeared before us in our County aforesaid and being examined by us privily and apart from her husband and having the deed aforesaid fully explained to her she the said Henrietta Fitzhugh acknowledged the same to be her act and deed, and declared that she had willingly signed, sealed and delivered the same and that she wished not to retract it.
