Last Will and Testament
of
George M. Small
I George Small of the county of Warrick and state of Indiana of sound mind and memory do make and publish
this my last will and testament & hereby revoking and mading void all other and former wills by me at any time
heretofore made -
First I will and bequeath that my body be decently entired.
Secondly I will and bequeath to my wife Esther Small all personal and real estate during her natural life.
Thirdly after the death of my wife I will and bequeath my personal property to my children Benjamin F Small Lewis
Small George W Small John D Small and Esther Small to be divided between them equally
Fourthly I will and bequeath to my son Benjamin F. Small lots no four (4) & (5) five & (132) one hundred
and thirty two in Alfred Leman's addition to the town of Grandview in Spencer County Indiana and twenty acres out
of the North West corner of fractional North East quarter of Section No 6 in twonship No 6 South of range No seven
west in Warrick County according to the plat hereto attached and made a part of this my last will and testament
Fifthly I will and bequeath to my son Lewis Small twenty five acres to be taken out of said fractional NE 1/4 of
Sec 6 T 6 R 7 west as markers on the plat hereto attached and made part of this my last will and testament also9
the north west quarter of the south west quarter of section no four in the township and range aforesaid except
ten acres to be taken in a square out of the south east corner thereof.
Sixthly I will and bequeath to my son George W. Small the south west quarter of the north west quarter of section
no four in township no six south of range no seven west in Warrick County Indiana the north east quarter of the
south west quarter of section no four in township no 6 south of range no seven west in said county and five acres
out of the south east corner of the north west 1/4 SW 1/4 of sec four (4) In the township and range aforesaid and
fifteen acres out of the south east corner of frantional north east quarter of section no six in township 6 south
of range no 7 west in said county according to the plat hereto attached and made part of this my last will and
testament
Seventhly I will and bequeath to my son John D Small the south west quarter of section no four in township no 6
south of range no 7 west in said county and five acres out of the south east corner of the north west quarter of
south west quarter of section no four in said town and range and twenty acres out of the north east corner and
twenty acres east of and adjoining Lewis Small's tract of fractienal north east quarter of section no six in township
and range aforesaid according to the plat hereto attached and part of this my last will and testament
plat refer to above (Plat drawn out)
Eightly I will and bequeath to my daughter Esther two hundred dollars to be paid to her on her arrival at the age
of twenty one years one hundred of which is to be paid by my sons John D Small and I hereby charge the lands divisee
by me to him with the payment of that sum and the other hundred dollars to be paid by my son Lewis and I hereby
charge the ----? divisee herein by me to him with the payment of that sum in case of her death before her arrival
at the age aforesaid with lawful issue above said sums to be paid to them
Ninethly my desire is that there shall be no administration of my estate and that my debts be paid by them out
of my personal property and should one contribute out of his own separate property more than another that he shall
be reimbursed by the others so that all may contribute equally
Witness my hand and seal this the 29th day of June AD 1863

Signed sealed published and delivered by the said George M Small as his last will and testament in our presence
and signed the same at the request of said George M Small in his presence and in the presence of each other as
subscribed witness thereto

State of Indiana Warrick County Be it remembered that on 14th day of June 1865 C W Armstrong one of the subscriging
witnesses to the writing and foregoing last will and testament of George M Small late of said county deceased personally
appeared before me Robert Taylor clerk of the court of common pleas of Warrick County in the state of Indiana and
being duly sworn by the clerk of said county upon his oath declared and testified as follows that is to say that
on the 29th day of June AD 1863 he saw the said
George M Small sign his name to said instrument in writing as and for his last will that this depenent at the same
time heard the said George M Small declare the said instrument in writing to be his last will and testament and
that this depenent at the same time heard the said George M Small declare the said instrument in writing to be
his last will and testament and that the same time at the request of the said George M Small and with his consent
attested and subscribed by the said C W Armstrong & Mitchell Bryan in the presence of the said testator and
in the presence of each other as subscribing witnesses thereto and that the said George M Small was at the time
of signing and subscribing of the said instrument in writings aforesaid of full age that is more than twenty one
years of age and of sound and disposing mind and memory and not under any coercion or restraint as the said depercent
verely believes and depenent says not C W Armstrong.
Sworn to and subscribed by the said depercent before me Robert Taylor clerk of said court at Boonville the 14th
day of June 1865 In attestation whereof I have hereunto subscribed my name and affixed the seal of said court Robert

State of Indiana Warrick County I Robert Taylor clerk of the curt of common pleas of Warrick County ---? do hereby
certify that this wi? last will and testament of George M. Small has been duly admitted to probate and duly proved
by the testimony of C W. Armstrong one of the subscribing witnesses thereto that a complete record of said will
and of the testimony of the said C W Armstorng in proof thereof has been by me duly made and recorded in book 2
at pages 61 & 62 & 63 of the records of wills of said county in attestatiuon whereof I have herewith subscreibed
my name and offixed the seal of said court at Boonville this 14 day of June 1865 Robert Taylor clerk

State of Indiana Warrick County I Robert Taylor clerk of the court of common pleas of said county do hereby certify
that the foregoing is a true and complete copy of the record of the will of George M Small the proof of probate
of said will and the clerks certificate that the same was duly proved and was admitted to probate as the same appears
of record now on file and remaining in my office
