Will of Nancy Small Shoptaugh
State of Indiana Spencer County
Know all who it may concern that I Nancy Shoptaugh widow of Peter Shoptaugh late deceased of County and state aforesaid
do make this my last will and testament to wit:
That all my just debts be paid out of my personal assets and that my real estate be equally divided between Mary
Shoptaugh, John Henry Shoptaugh and William Thomas Shoptaugh on the condition that neither one of said parties
named Mary Shoptaugh J H Shoptaugh WM T Shoptaugh sell their part or interest in such real estate to any other
person or party excepting one of these three and in case of death or vacation by either one of said perties the
interest of such decedent on vacation shall descend to the other two surviving or or occupying parties and that
all the other children of my body namely, Sarah Ash or her heirs, Indiana Jackson, Nancy White, Esau Shoptaugh,
Rebecca Woody, Matilda Kerrick, Missouri Shoptaugh, and Hardin Small shall receive from my personal assets the
sum of five dollars which either from my hand or from mary Shoptaugh, John Shaptaugh and William Shoptaugh within
one year from my decease and the conditions of this my will further is that my daughter Missouri Shoptaugh shall
have and hold a right to live and remain on these my premisis as her home so long as she may remain unmarried and
the provisions of this will is such that I retain full control of use of said property until my decease when my
interest in the same shall descend to the persons before named and in the manner before described this 18th day
of September 1876

Beofre me James Romine Clerk of the Spoencer Circuit Court this day personally cause james J. Horn and James L
Miller who being by me duly sworn depose and say that the written will of Nancy Shoptaugh dec was duly executed
that she was at the time of Executing same competent to devise her property of sound mind and memory and under
noi coercion or constraint whatever that she the said Nancy signed said will in the presence of these deponents
that they signed and subscribing witnesses thereto at her request and in the presence of said Nancy and each other
and further that testator was of full age to devise her property that she declared the same to be her last will
and testament and further day not?
