This indenture made the Tenth Day of August in the Eighth Year of the reign of our Sovereign Lord George the third by the Grace of God of Great Britain France and Ireland King Defender of the faith and so forth and in the Year of Our Lord One Thousand Seven Hundred and Sixty Eight between Sir Thomas WORSLEY of Appuldurcombe in the Isle of Wight in the county of Southampton baronet of the one part and William BANNISTER of the parish of Godshill in the Isle of Wight aforesaid Yeoman of the other part witnesseth that the said Sir Thomas WORSLEY for and in Consideration of the sum of Eight pounds of lawful Money of Great Britain to him in hand paid by the said William BANNISTER at or before the Sealing and Delivery of these presents the Receipt whereof he the said Sir Thomas WORSLEY doth hereby acknowledge and thereof and of every part thereof doth acquit release and discharge the said William BANNISTER his Heirs Executors and Administrators and every of them for ever by these presents hath demised granted and to farm lett on and by these presents doth demise grant and to farm lett unto the said William BANNISTER.
All that Messuage or Tenement with the Appurtenences commonly called or known by the name of Summersbury and three Acres of Land by Estimation (be it more or less) to the same belonging Situate lying and being in the parish of Godshill aforesaid and late in the Occupation or possession of Richard HOLLIS but now of the said William BANNISTER Except and always reserved out of this demise and grant unto the said Sir Thomas WORSLEY his heirs and Assigns all and all manner of Timber and Timber Trees Woods Underwoods Mines Quarrys and Royaltys whatsoever with free Liberty to and for the having taking carrying away and enjoying the same at his and their Wills and pleasures.
To have and to hold all and Singular the said demised premises and every part thereof with the Appurtenances (except before excepted) unto the said William BANNISTER his Executors Administrators and Assigns from and immediately after the end Expiration Surrender forfeiture or other Sooner determination of a certain Indenture of Lease bearing Date the Eleventh day of December One housand Seven hundred and thirty Seven made and granted of the Premises before demised by Sir Robert WORSLEY of Appuldurcombe aforesaid Baronet deceased to Richard HOLLIS of Rew in the parish of Godshill aforesaid Labourer for the term of fourscore and nineteen Years determinable on the Deaths of William and Elizabeth HOLLIS Children of the said Richard HOLLIS for by and during and unto the full end and term of fourscore and nineteen Years from thence next ensuing and fully to be compleat and ended if John BANNISTER son of the said William BANNISTER now aged about Nineteen Years shall and do so long live Yielding and paying therefore Yearly and every year during the said term hereby granted unto the said Sir Thomas WORSLEY his Heirs and Assigns the rent or sum of Two Shillings and Six pence of lawful Money of Great Britain on the feast days of the Annunciation of the blessed Virgin Mary and Saint Michael the Archangel by even and equal portions and it shall happen that the said Yearly rent of two shillings and Six pence or any part thereof shall be behind and unpaid by the space of twenty days over or after either of the said feast days whereon the same ought to be paid as aforesaid (being lawfully demanded) and no Sufficient Distress or Distress in or upon the said demised premises can or may be found had and lawfully taken for the Satisfying thereof with the Charges and arrears thereof if any be that then and from thence forth it shall and may be lawful to and for the said Sir Thomas WORSLEY his Heirs or Assigns into the said demised premises wholly to so enter and the same to have again repossess and enjoy as in his or their first and former Estate anything herein contained to the contrary notwithstanding and the said William BANNISTER for himself his Heirs Executors and Administrators and for every of them doth Covenant promise and agree to and with the said Sir Thomas WORSLEY his Heirs and Assigns by these presents in manner following (that is to say) that he the said William BANNISTER his Executors Administrators and Assigns shall and will Yearly and every Year from and after the Commencement of the said term and during the Continuance thereof will and truly pay or cause to be paid unto the said Sir Thomas WORSLEY his Heirs or Assigns the said Yearly rent or Sum of Two Shillings and Six pence of lawful Money of Great Britain at the days and times and in manner and form aforesaid and also Shall and will Yearly and every Year from and after the Commencement of the said term and during the Continuance thereof bear pay perform and discharge all and all manner of dues dutys taxes charges Services payments and Impositions whatsoever which shall be issuing due or payable out of for or in respect of the said demised premises or any part thereof To the King's Majesty his Heirs and Successors the Church and poor and to all and every other person or persons whomsoever
AND further Shall and will at his and their or some of their own like proper costs and charges Yearly and every year from and after the Commencement of the said term and during the Continuance thereof will and Sufficiently repair amend hedge ditch scour cleanse fence maintain and keep in repair the said demised premises and every part thereof in by and with all and all manner of needful and necessary reparations and Amendments whatsoever and the same premises and every part thereof being so well and Sufficiently repaired amended hedged Ditched fenced maintained and kept in repair as aforesaid at the end of the said term or other Sooner Determination of this demise shall and will quietly and peaceably leave and yield up unto the said Sir Thomas WORSLEY his Heirs or Assigns he the said William BANNISTER his Executors Administrators and Assigns having and taking in and upon the said demised premises of there to be had and can conveniently be spared by Assignment and not otherwise Sufficient Housecote hedgecote and firecote to be Spent and employed on the same premises and not elsewhere and that the said William BANNISTER his Executors Administrators and Assigns shall and will do and perform his and their suit and Service of Court at all and every the Courts of the said Sir Thomas WORSLEY his Heirs or Assigns to be held in and for the Manor of Appuldurcombe as often as any Court shall be there holden Upon every reasonable Summons and Warning to him or them in that behalf to be given provided always that when and as often as any Question shall arise whether the person on whose Death the term hereby granted is made determinable be living or dead it shall be incumbent on the person the interested in the premises by or under this demise to make good proof that such persons is then living or in default thereof the person about whom such Question shall arise shall be deemed and taken to be dead Any Method or Usuage in Law to the contrary in any wise notwithstanding and the said Sir Thomas WORSLEY for himself his Heirs and Assigns doth covenant promise and agree to and with the said William BANNISTER his Executors Administrators and Assigns by these presents that he the said William BANNISTER his Executors Administrators and Assigns paying the said yearly rent herein before reserved and observing performing and keeping all and Singular the Covenants and Agreements herein before contained which on his and their parts are and ought to be paid done and performed Shall and lawfully may peaceably and quietly have hold and enjoy all and Singular the said demised premises for and during all the said term hereby granted (determinable nevertheless as aforesaid) without any the lawful Lot suit trouble hindrance or denial of or by the said Sir Thomas WORSLEY his heirs Assigns or of or by any other person or persons lawfully claiming or to claim from by or under him
