1811 Deed - Rockbridge County
(Marginal Notes - 404 Forean SR. & wife To Forean Jr. Exam'd)
This Indenture made this 2nd day of December 1811 between John Forean
Sen. & Rebecca his wife of the one part and John Forean jun. of the other
part all of Rockbridge County in the State of Virginia Witnesseth: that
the said John Forean Senr and Rebecca his wife for and in consideration
of the promises herein after mentioned & of the sum of one dollar to them
in hand paid; do hereby grant Bargain sell & convey unto the said John
Forean junr a certain tract or parcel of land containing one hundred and
eight seven acres situated in the county aforesaid on the North end of
the House Mountain on the waters of Kerrs Creek & bounded thus:
Beginning at a Sugar tree on a branch thence 620 poles to a Chesnut oak
on the top of a high Bank of a run, South 20 E crossing a run 46 poles
to a large White oak by a path S30 E26 poles to two Chesnut oaks S10 W228
to a large white oak on the West End of the South Knobb S52. W107 poles
to a white oak North West 61 poles to a large double chesnut on the East
side of the Notrh Knobb N21. E330 poles to the Beginning ---- To have and
to hold the said tract of land with all its appurtenances to him, his heirs
and assigns forever, and the said John Forean Senr. & Rebecca his wife for
the considerations aforesaid do hereby sell & convey unto the said John
Forean Jun. the following property and house and all the farming utensils
of every kind now on the property to him, his heirs & _____ But the said
John Forean Senr & Rebecca his wife do convey the land aforesaid, and the
above mentioned property upon these conditions: That the said John Forean
Jr. is to support & maintain in sufficient cloathing, boarding & Lodging
the said John Forean Senr. & Rebecca his wife from the sealing of these
presents for & during their natural lives, which cloathing, boarding &
Lodging are at all times to be plentiful, comfortable, warm and decent.
That he is in like manner to support and maintain as aforesaid Mary Forean
& Margaret Forean, daughters of the said John Forean Senr. & Rebecca from
the sealing & delivery of these presents untill their marriages or arrival
at the age of twenty one years ---- And the said John Forean Junr. hereby
covenants to and with the said John Forean Senr & Rebecca his wife, that
he will well and truly perform & execute the conditions aforesaid; and
that if he at any time fails in the performance thereof, or any part
thereof it shall be lawful for the said John Forean Senr & Rebecca his
wife to turn the said John Forean Junr off the land hereby conveyed to
him & retake the property aforesaid & repossess the same & every part
thereof as if this deed had never been made and if the said John Forean
Junr shall fail in the performance of the conditions respecting the said
Mary & Margaret, or either of them, it shall be lawful for the said John
Forean Senr & Rebecca his wife to retake possession of the land & property
aforesaid.
In testimony whereof the said John Forean Senr. & Rebecca his wife &
the said John Forean Junr have hereunto set their marks & seals this day
& year aforesaid.

A Deed Between John Forean and Rebecca his wife and John Forean Jr.
was acknowledged in Court by the parties thereto (the said Rebecca having
been first (truly?) examined according to Law relinquishes her Dower
therein) and ordered to be recorded__
