1822 Rockbridge County, Virginia Deed - John FOREAN Sr. and John FOREAN,
Jr. to James CARUTHER Jr.

    This Indenture made this 27th day of May in the year of our Lord,
one thousand and eight hundred and twenty two between John Forean Sen.,
John Forean Jr. of the County of Rockbridge of the one part and James
Caruther of the other part;  Witnesseth: that the said John Forean Sen.
& John Forean Jr. in order to secure the payment of fifty eight dollars
& thirty one cents with interest from the first day of March last that
Rebecca Simonds has paid as security for said Foreans also the further
Sum of Sixty dollars that said Rebecca Simonds is bound for as security
for said Foreans in an execution for the benefit of James [Gold?] and
in consideration of the sum of one dollar, to the said John Forean Sen
& John Forean Jr. in hand paid by the said James Caruther Jr. (the
receipt whereof is hereby acknowledged) granted, bargained and sold
and by these presents do grant, bargain and sell unto the said James
Caruther Jr., a certain tract or parcel of land lying and being in
the County aforesaid containing by estimation one hundred and eighty
seven acres (be the same more or les) and bounded as follows, to wit:
 Adjoining the lands of David Connor, heirs, Daniel Gaylor, heirs and
other, the same land that the said Foreans now lives  on "To have and
to hold the Said lands, [tenements, heredetaments] and premises, herein
before mentioned  to be granted with their and every of their
appertenances unto the Said James Caruther Jr his heirs, executor,
administration and assigns forever:  [    ] nevertheless that the Said
James Caruther Jr shall soon as conveniently he can, after the 27th day
of July in the year of our Lord 1822.  If the said Rebecca Simonds or
his legal representative shall order: or the said Foreans shall request,
and after having given thirty days notice of the time and place of the
Sale on the Courthouse door of this County proceed to Sell the Said tract
or parcel of Land, to the highest bidder, for the best price that can be
obtained in ready money, and out of the monies arising from the sale, in
the first place to pay and satisfy all reasonable charges attending such
sale, and then the debt aforesaid, and the residue of the monies (if any)
arising from such sale as aforesaid, to the use of the said Foreans,
their executors, administrators, or assigns, or to such person or persons
as is by writing under theor hands shall appoint and in default of such
appointment to such person or persons as may be thereto entitled, by
virtue of the statute for distributing of intestate estates.  In witness
whereof the said John Forean Sen & John Forean Jr & James Caruther have
hereunto set their hands and seals on the day and year first written in
this Indenture.

    This deed from John Forean Sen & John Forean Jr to James Caruther Jr.
in trust for Rebecca Simonds was produced in Court and proved by the oath
of William McGill Margaret Simonds & Susanah McSimonds subscribing
witnesses thereto as to said Foreans and acknowledged by Jas. Caruther
and ordered to be recorded.
