William Marshal, 1st Earl of Pembroke. was regent in all but name
until his death in 1219. He achieved success in the civil war and,
assisted by the papal legate Guala, did much to restore royal
government in its aftermath. After Marshal's death there was a
struggle for political power between Hubert de Burgh, the justiciar,
and Peter des Roches, bishop of Winchester. Despite factional
disputes, by the time Henry III declared himself to be of age in 1227,
the minority government had achieved much. To have retained control of
royal castles was a notable achievement, while the seizure of Bedford
Castle from Fawkes de Breauté, a former protégé of King John, was a
spectacular triumph.
Early reign
Henry came under increasing foreign dominance. His marriage in 1236 to
Eleanor of Provence was followed by an influx of her Savoyard
relations, while the other significant group of foreigners was headed
by the king's half brothers, the Lusignans (children of his mother,
Isabella, by her second marriage). Attempts to recover the lost lands
in France with expeditions in 1230 and 1242 were unsuccessful. Only in
Wales did he achieve limited military success. In the 1250s plans,
backed by the papacy, were made to place Henry's second son Edmund on
the Sicilian throne; by 1258 these plans had involved the crown in an
impossibly heavy financial commitment of 135,000 marks. A lenient
policy toward the magnates did not yield much support for the king,
and after 1237 it proved impossible to negotiate the grant of direct
taxes with unwilling subjects.
Henry, moreover, faced a series of political crises. A baronial revolt
in 1233, led by Richard, son of William Marshal, ended in tragedy.
Richard was killed in Ireland, to the king's great grief: there were
allegations that the king had been tricked into agreeing to the earl's
destruction. Further political crises in 1238 and 1244 did nothing to
resolve tensions. In 1238 the king's brother, Richard, Earl of
Cornwall, rebelled, and leading advisers such as William of Savoy left
the royal council. In 1244 Henry III faced opposition in Parliament
from both lay and ecclesiastical magnates. A draft proposal suggested
a complex system for adding four men to the council, who were to be
"conservators of liberties" as well as overseers of royal finance. The
king was able, however, to exploit the differences between his
opponents, and their campaign achieved little. Henry was naive; he
was, on the one hand, overly trustful and, on the other, bitter
against those who betrayed his trust. There was growing discontent at
a local level with the conduct of royal government.

A myth often repeated and published by writers, who probably believe
it true, states that James came to this country in the ship Anne.
From the Early Records of the Town of Portsmouth, edited by the State
Librarian, under direction of the Rhode Island Legislature, published
1901 and from Colonial Records of Rhode Island, the account of James
Badcock's first twenty years in Rhode Island was copied. His
residence for that period was in Portsmouth, and the records of that
town show that his name was spelled in various ways, probably
according to the fancy of the clerk of the town meeting, namely
Badcocke, Badcock, Badcook, Badcooke.
For the first forty years the surname of James and his sons was
usually written Badcock. In the Probate records of John Badcock's
estate the name is spelled Babcock, and at that time, that spelling
seens to have been adopted by the family. The Massachusetts branch of
the family appear to have adopted the new spelling still later.
The English descendants of the family from which James undoubtedly
sprang still retain the name Badcock. In Feb 1900, Mr. Jasper C.
Badcock, who was Comptroller of the London Postal Service, expressed
the opinion that he and the American Babcocks sprang from the same
source.
James Badcock was admitted an inhabitant of the towne of Portsmouth 25
Feb 1642. At that time no one was allowed to "build or plant" without
first having been voted at town meeting as an inhabitant. At a town
meeting held Oct 5 1642, James Badcock and Richard Moris were ordered
"to lock up all the armes in the Towne within the month above writ"
and "to mend any which were defective for use". Owners were to
forfeit five shiling if they failed to bring arms in time. At the
same meeting ten acres of land were ordered to be "laide out to James
Badcock at the first brooke, next the footpath eastward." The land is
described as "lying Toward the head of said brooke." About this time
there must have been a threatening of war in the air, as every man was
ordered to have "four pounds of shot and two pounds of powder laying
by him in readiness by the 24th of this month, and to be in readiness
to assemble at the beat of the drum". James was made a freeman 10 Jul
1648, and was appointed a member of a large committee "for the tryall
of the general officers." On 28 Dec 1648 it was granted "to have four
acres added to his house lot". He was chosen a juryman 21 Nov 1649,
Jun 1653, 11 Aug 1656, 2 Mar 1657, and Oct. 1661. He was chosen an
assessor 19 Feb 1650.
On 2 May 1650 James with five others was ordered by the "General
Courte, all excuses set aparte, to mende and make all locks, stocks,
and pieces which by order from the duty was not performed a penalty of
10 pounds was levied, and men who failed to bring in their arms
forfeited 10 shillings each".
In 1655, his name appears in the "Poule of ye Freeman" of Portsmouth.
James was appoinnted an appraiser of the estate of John Wood 7 May
1655. On 8 Apr 1656 James and seven other were "appointed to go over
to the mayne to treat with the Indian Sachems to inform them of the
mynd of the towne that they come not upon the Island but according to
order given". 6 Jan 1657 "James Badcock and John Sanford are again
authorized to meet with Newport men according to former orders". James
and six others were chosen a committee to meet with committees
appointed from other towns.
James Badcock moved to Westerly in March, 1662, but the last record
which refers to him in Portsmouth is dated 19 Dec 1662. At this time
reference is made to a committee which was previously appointed to lay
out certain lands, and this committee, or the larger part of them,
were ordered to restore to William Wilbor three quarters of an acre of
land which the committee had previously taken from him in their
official work. James was one of this committee, and as he is referred
to as James Badcock, Sr. It is probable that James, Jr. who had
reached his majority that year, was then living in Portsmouth.
On 29 Jun 1660 a tract of land estimated to be twenty miles by ten
miles, known as Misquamicut, afterward Westerly, was purchased from
the Indian Chief Sosoa, by a company headed by William Vaugn. This
company, numbering sixty or more, was organized at Newport, RI. The
purchasers well knew that in 1658 the Massachusetts colony claimed
this tract, calling it a part of Southertown and adding it to Suffolk
County, Boston being the county seat. 27 Aug 1661 the company appealed
to the Colonial Assembly of Rhode Island for assistance in defending
their purchase against "adversaries which by a species of intrusion
are seeking to make inroads upon our privilege of colonies
jurisdiction."
From Col. of R.I. Hist. Soc, published 1835,vol iii,pp.257-261, the
following is taken:
"Aug 31 1661, all purchasers were ordered by the trustees to meet at
Cabel (Caleb) Carrs, at Newport, to go to Squamucuck." Two weeks
later, Sept. 15, the company was at Misquamicut, and a certain part of
the tract was apportioned by lot. The number of James' lot was #52.
At the time of this visit arrangements were made for a temporary
occupancy of the land. The company was divided into small parties,
each party to stay upon the land for a certain number of weeks. Anyone
who refused to serve had to provide a substitute or pay a fine. 1 Nov
1661, Tobias Saunders, Robert Burdet(Burdick), and Joseph Clark were
fined forty pounds each and imprisioned "until their fines should by
paid, and until each should give security in 100 pounds for his future
good conduct". Nov 12, 1661, The number of trustees for the
"Squamicuck" purchase was increased from eight to eighteen. Two of
the names added were James Badcock, and John Badcock. The following
Mar, 1661-2, the company made their first permanent settlement at
Misquamicut ( Westerly). Before starting from Newport the company
named James and four others who were appointed and "Commissioned to
act for us as to the managing of our affairs at Misquamicut who are to
discourse and answer to any that shall come to debate matters with
them. They or any two of them to forewarn any whatsoever either to
build or sow, mow or fall timber upon that tract of land". In 1662
Connecticut laid claim to the tract, and did not entirely relinquish
her claim until 1728. Soon after arriving at Misquamicut disputes
arose with Connecticut authorities about the boundary line. These
didputes led to arrests, imprisonments, fines, appeals, and the
appointment of commissions between the two colonies. March 18 1664,
James petitioned the General Court, sitting at Newport, for protection
"against such ritous actings as are done and committed by the men of
Southertown against him". (Southertown being Conn.) The court
requested the Governor and Deputy Governor to send letter to the
government of Connecticut" to see what they will say by way of anwser
to such riotous acting as are done and committed by the men of
Southertown against the said Badcock". In 1665, James sold his
dwelling house, barn, orchard, etc. in Portsmouth, RI to Thomas Fish
for fifty pounds; his wife Sarah, giving her consent. James Jr.
witnessed the deed. It appears that in May 1667, James Badcock, with
a company of men drove the Pequot Indians from planting ground claimed
by the Indians, located on the Misquamicut purchase east of the
Pawcatuck River. May 18, 1667, Harmon Garret petitioned the General
Court, praying "that such men as wear hats and clothes like
Englishmen, but have dealt with us like wolves and bears, may be
called to account." At a Conn. court held at Wickford (which is now
RI). June 21 1670, James was charged by Mr. Gookin of Cambridge, Mass
with driving Harmon Garret and his Indians (tenants of Gookins) from
their lands. Westerly was incorporated May, 1669 at which time there
were twenty-four freemen in the town, four of whom were Badcocks. On
17 Jun 1670, James Badcock Sr. by virtue of a warrant issued by Tobias
Saunders arrested three Conn men, John Frink, Benjamin Palmer, and
Thomas Bell, who had crossed into RI to summon the Westerly men to
appear before a certain court to be held in Conn. Said Frink was sent
to RI Jail. The next day Mr. Badcock was arrested by officers from
Conn. and placed under a bond of 100 pounds to "personally appear and
surrender himself to Nehemga Palmer, Constable of Stonington,
protempore, Wednesday morning next by six of the Clock". Tobias
Saunders and Thomas Stanton became his bondsmen, each for 50 pounds.
Col. A. J. Babcock, of Springfield Illinois says" We take it for
granted that bright and early six of the clock on the morning of June
23 1670, Badcock was there ready to answer all charges of the adverse
faction; but it appears they were not ready to probe these charges.
The case was contunued until June of the next year, Badcock giving a
bond in the sum of 20 pounds to appear at the county court in New
London, Conn. June 23 1670, is supposed to have been the date that
James Sr. made affidavit to the ages of himself and his two sons. May
18, 1671, James Badcock and John Badcock, are recorded as renewing
their allegiance to RI and the king; most of the inhabitants,
including James, Jr. and Job Badcock, having renewed their allegiance
the previous day. James in his fifty-ninth year, 1678, was baptized by
Elder William Hiscox, and united with the Seventh Day Baptist church
of Newport and Westerly. That James owned land in Westerly is proved
by Westerly Town Records book i p. 66. These records show that April
17 1691, "Joseph Babcock of Stonignton relinquished to his brother
James Babcock of Westerly, for a consideration, his claim to land
belonging to their father, the late James Babcock of Westerly, and
lying on the east side of the Pawcatuck Piver. He declared his last
will and testament to his sons John and Job, June 12 1679, and they
appeared Sept 17 1679 before the Govneror of RI at a court held at
Westerly and "being solemnly engaged" testified to the truth of their
father's will as he verbally gave it to them. The will is recorded in
vol i, Land Evidence, in the office of the Secretary of State,
Providence RI. Among the several legacies named in the will, he
"bequeathed unto his son Joseph all his housing and lands for him, the
said Joseph to take unto his possession when he shall attain to the
age of twenty-one years". These glimpses of an interesting life show
that james Badcock Sr. was a man of sterling integrity and of strong
convictions. He was respected by his nieghbors, honored and trusted
as a citizen, and ready to serve the community in whatever capacity he
was appointed.
His first wife's name was Sarah ______. She died about 1665. He
married second Elizabeth _____.
