In the name of God Amen. I Augustine Woolfolk of the county of Louisa and state of Virginia being of sound mind and memory tho’ weak in body do make this my last will & testament in manner and form as followeth (Viz.)

 

My desire is that all my just debts be paid.

 

ITEM: I give to my son Joseph Woolfolk all my land in Louisa and Hanover county and also the following negroes Viz.: Duke (the shoemaker) Barnett, Little ?illy, Gabriel, Davy, ?ann, and old Bell, one desk and a large looking glass to him and his heirs forever.

 

ITEM: I give to Thomas Dickinson three negroes Viz.: Edmund, Davy & Doll, which he has in his possession, and also one negro girl named Caty and Pegg her mother, to him and his heirs forever.

 

ITEM: I give to Newel Walton the following negroes Viz.: Lucy and his increase Harry and Cato; which he has in his possession and also I give to said Walton one negro girl named Little Molly and a negro man named Thomas Hackett which last two mentioned negroes I give on the express conditions (Viz.: if the said Walton will give up his claim he has against me (if not) my desire is that the said two negroes be sold by my exors to pay said Waltons claims.

 

ITEM: I give to Robert Lewis’s four children now living one negro man named Harry to them and their heirs forever, also forty pounds which my executor must pay to Robert Lewis.

 

ITEM: I give to Joseph Woolfolk Jr. (son of my son Joseph Woolfolk) one negroe boy named Joe to him and his heirs forever.

 

ITEM: I give to John L. Lewis son of Augustine Lewis one negro boy named Duke and one cow and calf to him and his heirs forever.

 

ITEM: I give to Robert Clough’s two children Wm. L. Clough and Martha Clough two negroes Esther and Adam which I have made a deed of Gift of which said deed has not be recorded.  I also give to said children one cow and calf which is now in the possession of Robert Clough.

 

ITEM: I give to Mary Ann W. Clough (daughter of Robert Clough) my old negro woman named Molly, to her and her heirs forever.

 

ITEM: I give to Charles Terrell one horse worth about twelve or fifteen pounds to be furnished him by my exors hereafter named.

 

ITEM: My desire is that after all my debts and legacy’s in is paid all of which I desire should be paid from the sale of my stock house hold and kitchen furniture plantation utensils and the present crop and after the sale aforesaid if any money should there be left my desire is it should be equally divided among my three children, Viz.: Nancy Dickinson, Agness Walton and Joseph Woolfolk or their representatives and lastly I appoint Joseph Woolfolk (my son) and Thomas Dickinson exors to this my last will and testament.

Be it known unto all men by these presents that I Augustine Woolfolk of the County of Louisa have made and declared that my last will and testament in writing bearing date &c.  I the said Augustine Woolfolk do by these presents contained in the codicil confirm and ratify my said will and do give and bequeath unto Mary Ann W. Clough (daughter of Robert Clough the said forty pounds I have in my will given to Robert Lewis and the said Ro. Lewis shall have my old negro woman named Molly (which I had willed to Mary Ann W. Clough and my will and meaning is that this codicil or schedule be esteemed and adjudged to be part or parcel of my said will and testament and that all things therein contained and mentioned be faithfully performed in a full and ample manner, in every respect as if the same were so declared and set down in my will.

 

In witness whereof I have set my hand and seal this 24th Sept 1808.

At a Court held for Louisa County on the 10th day of October 1808 this will was this day exhibited in open court by Joseph Woolfolk one of the executors therein named and was proven by Wingfield Cosby, David Spicer and Garland Dickinson three of the witnesses thereto and by the Court ordered to be recorded and the codicil thereto annexed was proved by the oath of John Yearman a witness thereto and by the court ordered to be recorded and the said executor having made oath thereto and entered into and acknowledged his bond with approved security considered as the law directs certificate is granted him for obtaining probate thereof in due form.

Louisa County October Court 1808 – It is ordered that Skelton Smith, Wingfield Cosby, Barnett Smith & Peter Cosby or any three of them do appraise the slaves if any & other present estate of Augustine Woolfolk and make report thereof to Court.  John Poindexter C.L.C.

 

Agreeable to an order of Louisa Court hereunto annexed we the subscribing being first sworn have this 12th day of Novr 1808, Appraised the slaves personal estate of Augustine Woolfolk dec’d, which are as followith Viz:

several beds and furniture, sheets, quilts, table cloths & yardage, Desk, desk box, chest, looking glass, large looking glass, pewter, china bowls, cups, saucers, silver spoons, knives & forks, china, candle sticks, coffee pots, butter pots, stew pot, an old mans saddle, salt seller, snuff bottles, mugs, wine glasses, tumblers, dishs, canns, large walnut table, small walnut table, elbow chair, small chairs, 1 large Bible, books, jugs, bottles, grind stone, fire dogs, hoes, hilling hoes, w. hoes, wedges, axes, grubbing hoes, chains, addze, saws, shovel tongs, cart boxes & bells, ?tages & hames?, ploughs, single trees, clives, [many other farm implements], bee hives, bay horse, colt, cows, sheep, geese, hogs, 65 gallons cyder, gun, corn, fodder,

Negroes: man Harry, man Duke, man Barnett, boy Duke, girl Caty, girl Salley, boy Joe, woman Peg, woman Molly, woman Old Molly.

 

At a court held for Louisa County on 14th day of May 1810. This appraisement of the estate of Augustine Woolfolk was this day in open court returned and by the court ordered to be recorded. By Wingfield Cosby, Shelton Smith, Peter Cosby.

In obedience to an order of Louisa Court bearing date Feby 1810 we the commissioners have this day proceeded to settle the exo’rship of Joseph Woolfolk on the estate of Augustine Woolfolk dec’d & find that the funds left by the testator have been applied agreable to the will of said testator & there is a deficiency of one hundred and ninety eight pounds sixteen & eleven pence half penny as stated in the settlement.
