IN THE
NAME OF GOD AMEN. I Francis Woolfolk of the County of
Sussex, being sick and weak but of sound and disposing mind and Memory, do make
and ordain this my last Will and Testament in & form following, vizt.
IMPRIMIS.
I give to my loving and beloved wife Elizabeth Woolfolk and to her Heirs all the Negroes and
estate of every kind I got my intermarrying with her as well the hire of the
said Negroes that is now due, as the hire for the present Year, likewise Two
feather beds and furniture, my double riding chair & Harness, all my glass
and Crockery Ware, knives & forks, half a dozen windsor settings chairs,
one black Walnut Table, one half of my Table linen, one doz. Flax and Cotton
Towells, one third of the Virginia Cloth not made up that shall be in the House
at my death and all my kitchen furniture.
I also lend to my loving Wife during her widowhood my Negroe boy Watt.
ITEM:
My will and desire is that my Just debts be paid all the residue of my Estate
be it of what kind or Qality [sic] soever be equally divided between my two
daughters Sarah and Anne G. Woolfolk
when ever either of my said daughters shall Marry or arrive to the Age of
Twenty one Years. Provided neither of
my said daughters should marry or live to the age of twenty one years and my
wife should now be pregnant my desire is in that Case be the child he or she
shall have whole the said Legacy, but in case the sd supposed child be it son
or daughter should died without lawful issue than my Will and desire is that
the aforesaid Legacy be equally divided between my brothers and Sisters that
shall be then living and my kinsman Paul Woolfolk.
My Will
and desire is that my estate be not appraised.
Lastly.
I nominate my brother John G. Woolfolk and my kinsman Paul Woolfolk Extors of this my last Will and
Testament. In Witness whereof I hereunto
set my hand and Seal this 17th day of April 1794

CODICIL anexed [sic] to this my last will and Testament Witnesseth that Whereas
I Francis Woolfolk
did on the Seventeenth day of April One thousand seven hundred and ninety four
make my last Will & Testament and appointed my brother John G. Woolfolk & my kinsman
Paul Woolfolk
executors to the same, My Will and desire further is that I do hereby
constitute and appoint my friend William Massenburg one of the Executors with
my said Brother and kinsman. Witness my
hand & seal this 4th day of May 1794.

At a
Court for Sussex County the 3rd day of July 1794. The last Will and Testament of Francis Woolfolk dec'd was presented into Court by
John G. Woolfolk
and William Massenburg two of the Executors therein named. The same was proved by the Oaths of Jesse
Barker and John Mason Sen. Two of the Witnesses thereto. Also the Codicil thereto annexed was proved
by the Oaths of Robert Roe and Euclid Langford the Witnesses thereto which
together with the said Will is Ordered to be recorded. On motion of said Executors who made Oath
and gave Bond according to Law.
Certificate is granted them for obtaining a probate thereof in due form.
