This indenture made the twenty eighth day of June in the year of one thousand seven hundred and seventy  between Richard Woolfolk of the county of Albermarle of the first part and John Mitchell surviving (or only acting) partner of Hugh Lenox, William Scott & company of the town of Fredericksburg in the county of Spotsylvania of the second part and Samuel Brockman of the county of Orange of the third part.  Whereas the said Richard Woolfolk is seized in Fee simple of and in a tract of Land lying in the said county of Orange containing nine hundred and twenty acres which was granted to the said Richard Woolfolk by Patent and bounded as in the said Patent is mentioned and expressed and being so seized he the said Richard Woolfolk by indenture bearing date the twenty third day of November one thousand seven hundred and sixty four for the consideration therein mentioned did grant bargain and sell unto the aforesaid Hugh Lenox William Scott and company the aforesaid tract of land and premises to have and to hold to them the said Hugh Lenox William Scott and company their heirs and assigns forever with a provisory or condition therein contained for making void the same on the said Richard Woolfolk paying to the said Lenox Scott & Company the sum of ninety five pounds current money with interest thereon the first day of July then next following as in and by the said Indenture now of record in the county [blot] of Orange may among other things more fully and at larger appear  Now this indenture witnesseth that for and in consideration of the sum of eighty one pounds six shillings and eight pence current money by the said Samuel Brockman to the said John Mitchell in hand paid with the consent of the said Richard Woolfolk testified by his being a party to and sealing and delivering these presents being in part of the principal and interest now due to the said Lenox Scott and Company upon the mortgage aforesaid and for and in consideration of the sum of five shillings current money by the said Samuel Brockman to the said Richard Woolfolk in hand the receipt of which several sums of money is hereby acknowledged he the said John Mitchell surviving (or only acting) partner of Hugh Lenox William Scott & company by direction and appointment of the said Richard Woolfolk testified as aforesaid and the said Richard Woolfolk have and each of them hath granted Bargained and sold and by these presents do grant bargain and sell unto the said Samuel Brockman his heirs & assigns forever part of the aforesaid tract or parcel of Land bounded as followeth to wit: Beginning at a Pine and a scrub oak saplin corner to the said Brockman in Richard Woolfolks line thence North 41 degrees east 204 poles to three pines by a branch side corner to John Stevens thence north 49 degrees west 369 poles to a double pine corner to the said Stevens thence south 43 degrees west 140 poles on the north side of a small branch in the said Woolfolks line thence south 39 degrees east 380 poles to the beginning containing 400 acres be the same more or less together with al ways waters priviledges and improvements to the same belonging or in any way appertaining and the reversions, remainders, rents, issues & profits.

 

To have and hold the above bound and described lands and premises & every part and parcel thereof unto the said Samuel Brockman his heirs and assigns forever to his and their own use and the said Richard Woolfolk for himself his heirs exors & adms doth covenant and grant to and with the said Samuel Brockman his heirs and assigns that he the said Saml Brockman shall and may at all times hereafter peaceable and quietly have hold possess occupy and enjoy the said hereby granted and conveyed Land and every part there of without the lawful claim or interruption of him the said Richard Woolfolk or any other person whatsoever and that free from all prior sites changes & encumbrances whatsoever (the quitrents hereafter arising only excepted) and that the said Richard Woolfolk and his heirs the said Land and premises and every part thereof unto the said Samuel Brockman his heirs and assigns against him the said Richard Woolfolk and his heirs and all and every other person whatsoever shall and will warrant and forever defend by these presents and the said John Mitchell for Lenox Scott and company their selves and their heirs doth convent and grant to and with the said Samuel Brockman that the said Lenox Scott and company [blot]the said John Mitchell as surviving (or only acting) partner of the said Hugh Lenox, William Scott and company hath not done made committed or omitted any act matter or thing whereby or by means of which the title of the said Samuel Brockman in or to the said granted land or premises maybe e affected or prejudiced.  In witness whereof the said Parties have hereunto set their hands and affixed their seals the day and year first above written.

At a court held for Orange County on Thursday the 26th of July 1770.  This indenture from Richard Woolfolk and John Mithcell to Samuel Brockman was proved as to the exor of John Mitchell by the oaths of James Maury James Somervill and John Allcock.

 

And at another Court held for sd county on Thursday the 23rd of August 1770.  The said indenture was proved as to the execution of Richard Woolfolk by the oaths of Wm. Moore John Grigsby and John Henderson three of the witness thereto and ordered to be recorded.

Orange Co., Va. DEED BOOK 15, pages 256 – 258  25 Oct 1770

 

This indenture made this xxv day of October in the year of our lord Christ one thousand seven hundred and seventy by and between Richard Woolfolk Late of Orange County in the colony of Virginia one the one part & John Henderson of the other part.  Witnesseth that he the said Richard Woolfolk for Divers good causes and considerations  himself hereunto moving but more especially for and in consideration of the sum of sixty two pounds ten shillings current money of this our said colony in hand paid by the said John Henderson unto him the said Richard Woolfolk immediately before the ensealing & delivery of these presents the receipt whereof he the said Richard Woolfolk doth hereby acknowledge and confess himself fully satisfied and paid & doth thereof & of every part and parcel thereof fully freely and clearly acquit exonerate and discharge him the said John Henderson his heirs and assigns by these presents his heirs and assigned by these presents he the said Richard Woolfolk hath given granted bargained sold released alienated enfeoffed and confirmed and by these presents doth give grant Bargain sell release alienate enfeoff & confirm unto him the said John Henderson one certain tract or parcel of Land by estimation three hundred acres be the same more or less situate lying and being in Orange County aforesaid on the North side of the North Anna River of the Pamunkey some small distance off from the river and bounded as followeth that is to say Beginning at a white oak corner of said Richard Woolfolk & Joseph Woolfolk on said John Hendersons line and extending thence with the same to the Land and Line of Samuel Brockmans purchase of the sd Woolfolk thence up said Brockmans Line to the Bear Branch thence down the bear branch to Joseph Woolfolks line thence down the same to the Beginning to have & to hold the said lands and premises together with their and every of their appurtenances unto him the said John Henderson to the only proper use & behoof of the him the said John Henderson his heirs and assigns forever and he the said Richard Woolfolk for himself and his heirs unto the said John Henderson his heirs and assigned forever the said Lands and premises with their and every of their appurtenances shall & will warrant and forever defend by these presents against himself the said Richard Woolfolk his heirs assigns & against all and every other person & persons having or lawfully claiming any right or title to the same or to any part or parcel thereof in Testimony whereof he the said Richard Woolfolk hat hereunto set his hand & affixed his seal the day and year first above written,

 

Signed sealed and delivered and peaceful possession  & seizen of the above mentioned lands and premises by the said Richard Woolfolk given and granted unto him the said John Henderson & by him taken and received the say and year as above, accordingly to the Tenor of this deed in the presence of [blank]

At a court held for Orange County on Thursday the 25th day of October 1770 this Indenture from Richard Woolfolk to John Henderson was acknowledged by the said Woolfolk & Ordered to be recorded. Test: Geo. Taylor COC.

 

 

This Indenture made this xxv day of October in the year of our Lord Christ one thousand seven hundred and seventy by and between Richard Woolfolk late of Orange County in the colony of Virginia of the one part & John Burrus of the said county and colony of the other part witnesseth that he the said Richard Woolfolk for divers good causes and considerations himself of the said Richard hereunto moving but more especially for and in consideration of the sum of twenty five pounds current money of the said colony in hand paid by the said John Burrus unto him the said Richard Woolfolk paid immediately before the ensealing and delivery of thes presents the receipt whereof he the said Richard Woolfolk doth thereof & every part and parcel thereof fully freely & clearly acquit exonerate & discharge Richard Woolfolk hath given granted bargained sold, remised, released, alienated, enfoefold , confirmed, and by these presents doth give, grant bargain sell remise release alienate, enfoff and confirm unto him the said John Burrus his heirs and assigns forever one certain tract or parcel of Land situate lying and being in Orange County on the north side the North Anna River of Pamonkey some small distance from the said river and being by estimation two hundred acres be the same more or be it less & bounded as followeth that is to say beginning at Joseph Woolfolk’s  line on the Bear Branch and extending up the Branch to the Line of Samuel Brockman thence with Brockmans line to Joseph Woolfolks line red oak thence down sd Joseph Woolfolks line to the beginning.

 

To have and hold the said lands & premises together with their and every of their appurtences unto him the said John Burrus to the only proper use and behoof of him the said John Burrus his heirs and assigns forever and he the said Richard Woolfolk for himself and his heirs the said Lands and premises unto him the said John Burrus his heirs the said lands and premises unto him the said John Burrus his heirs and assigns forever.  Shall and will warrant and forever defdnd by these presents against himself the said Richard Woolfolk his heirs and assigns against all and every other person or person having or lawfully claiming any right or title to the same or as to any part or parcel thereof freely & clearly exonerated & discharged of all and all manner of other and former bargains sales leases title of Dower and all other rights and estates whatsoever.  In testimony whereof he the said Richard Woolfolk hath hereunto set his hand affixed his seal the day and year first above written.

 

Signed sealed and delivered & quiet & peaceable possession & seizen of the above mentioned lands  and premises given & granted by the sd Richard Woolfolk unto the said John Burrus & by him taken & received the day and year as above warrant to the tenor of this deed in the presence of  [blank]
